- COLSTON's Will proved
The Last Will and Testament of WILLIAM COLSTON, deced., was presented in Court by MARY Colston, one of the Executors, who made Oath thereto and being proved by the Oaths of ANN WEBB and JOSEPH BROWN, two of the witnesses thereto, is admitted to Record; And on the motion of the Executrix and her performing what is usual in such cases, Certificate is granted her for obtaining a Probate thereof in due forme
- COLSTON's Estate to be appraised
NEWMAN BROCKENBROUGH, EDGCOMB SUGGITT, GILES WEBB and FRANCIS LUCAS or any three of them some time between this and the next Court are appointed to appraise all and singular the Estate of WILLIAM COLSTON, deced., which shall be presented to their view in money and make report thereof to the next Court. CHARLES BARBER, Gent., or any other Justice of the Peace for this County, is requested to administer an Oath to the Appraisers for their true appraisment of the Decedent's Estate as also to MARY COLSTON, the Executrix, for her true discovery thereof

THIS INDENTURE made the Second day of March one thousand seven hundred & twelve Betweene FRANCIS LUCAS and ANNE his Wife of Parish of Farnham and 130 County of Richmond of one partie and WILLIAM COLSTONE of the said Parish and County of the other parties; Wittnesseth that FRANCIS LUCAS in consideration of Five shillings lawful! money of England to him in hand paid by WILLIAM COLSTONE, do by these presents bargaine and sell unto ye said WILLIAM COLSTONE his heirs all that parcell of land containing One hundred acres be the same more or loss scituate in the Parish of Farnham and County of Richmond and on the North side of RICHARDSONS CREEK near to ye mouth thereof, begining att ye corner of a Patent of Land formerly granted to ANTHONY JACKMAN and now in the possession of ye said WILLIAM COLSTONE and running up ye sd. line N: E. by E: to the head thereof, thence the course of my Patent to the said RICHARDSONS CREEK, thence downe the said Creek its several courses to the begining; being now in the tenure and occupation of said WILLIAM COLSTONE bounded as above with all houses gardens orchards priviledges and comodities to the parcell of land belonging, To have and to hold the parcell of land unto WILLIAM COLSTONE his heirs dureing the full time of one whole year next coming paying therefore the rent of one ear of Corne on the Feast day of the Birth of our Lord God nett ensueing, if lawfully demanded, to the intent that by virtue of these presents and of the Statute for transferring uses into possession, the said WILLIAM COLSTONE may be in the actuall possession of ye premises and be therefore enabled to accept a grant of the reversion and inheritance thereof; In Wittness whereof the parties first above named hath nterchangeably sett their hands and affixed their seals the day and year first above written

THIS INDENTURE made the third day of March one thousand seven hundred and twelve betweene FRANCIS LUCAS and ANNE his Wife of the Parish of Farnham and County of Richmond of one partie and WILLIAM COLSTONE of the Parish and County aforesaid of other partie: Wilts: that FRANCIS LUCAS in consideration of the summe of Twelve pounds Sterl. to him in hand paid by WILLIAM COLSTONE, by these presents doth bargaine and sell unto WILLIAM COLSTONE tin his actual possession now being by virtue of a bargaine and sale to him thereof made for one whole year and by force of the Statute for transferring uses into possession) and to his heirs all that parcell of land containing One hundred acres be the same more or less, Begining (the description of the bounds repeated as in the foregoing Lease); To have and to hold the parcell of land with appurtenances unto WILLIAM COLSTONE his heirs to be holden to the Cheif Lord or Lords of the Fee or Fees of the premises by the rents and services for ye same due and of Right accustomed to be paid; freely and clearly discharged from all Incumbrances whatsoever, and ye said FRANCIS LUCAS his heirs shall warrant the said parcell of land unto WILLIAM COLSTONE and his heirs against all persons slaying under ye sd. FRANCIS LUCAS came into Court and acknowledged this his Deed unto WILLIAM COLSTON and it was admitted to Record; Also JOHN NAYLOR by virtue of a Power of Attorney from ANNE LUCAS, the Wife of the said FRANCIS LUCAS, to him in that behalfe made, relinquished her ye said ANNE's Right of Dower in the land conveyed in this Deed unto the said WILLIAM COLSTEN which is also admtted to Record

KNOW ALL MEN by these presents that I ANNE LUCAS, the Wife of FRANCIS LUCAS, of the County of Richmond do appoint my trusty friend, JOHN NAYLOR, of ye said County, Gent., to be my lawful! Attorney to acknowledge all my right and title of Dower of a certain parcell of land sold and conveyed to WILLIAM COLSTON Gent., by Deeds of Lease and Release which said Release bears date ye same day of these presents, giving and by these presents granting unto my said Attorney full power and lawfull Authority to acknowledge my Right of Dower to the said Lands in Richmond County Court next as if I my self was there present; In Wittness whereof I have hereunto sett my hand and seale this 3d day of March Anna Dom 1712

KNOW ALL MEN by these presents that wee WILLIAM COLSTON & CHARLES BARBER are held and firmly bound unto SAMLL. SAMFORD his heirs in the sum of Twenty pounds current money to the which payment well and truely to be made upon demand we bind ourselves our heirs firmly by these presents; Witness our hands and seales the 4th day of Aprill 1717
THE CONDITION of the above obligation is such that whereas the above bound WILLIAM COLSTON hath appealed from a Judgment of Richmond Court obtained against him by SAMLL. SAMFORD bearing equal! date with these presents; to the Ninth day of the next General! Court; Now if WILLIAM COLSTON shall appear on the said Ninth day of the next Genii: Court and prosecute his said Appeale and if cast shall pay and satisfye the prin cipall Debt damages & costs with fifteen p cent upon the same; That then this Obligation to be void and of none effect, or else to remain in full force and vertue
