land and all appurtenances to wife Mary, after her death, to son John, if he has no heirs, to dau. Betty, if she has no heirs, to dau. Joannah, if she has no heirs, to eld. dau. Sarah BRUCE, and, if she has no heirs, to go to Job TILLERY's proper heir at law; my sd. land above given to my dau. for want of my son his having issue, I value to be worth 4000 lbs of tobacco, I therefore order that whichever of my four daus. shall happen to enjoy my sd. land...she so inheriting is hereby obliged to pay her sisters their proper shares of the value I have set upon the land; ex: wife; wits: Daniel JACKSON, Thomas SAMFORD, Job TILLERY. Will of Phillomon Bird of Richmond Co. 1751/52. Records of Richmond Co., VA. Warsaw, VA. Will Book No. 5, p. 686. Birds Will. In the Name of God Amen I Phillomon Bird of the County of Richmond and parish of Farnham Being sick and week in Body but in perfect sence and memory doe make this my Last Will and Testament in manner Following (vizt) Imprimis.
I Bequeath my soul to Almighty God and my body to be buried at the Discretion of my Executors hereafter mentioned.
Item. I give and bequeath my Land and all Its Appurtences to my Loving Wife Mary for and During her Natural Life, and after her death to my Son John Bird and the heirs of his Body Lawfully Begotten and for want of such Issue, Then my will and desire is that my Daughter Mary Ann Bird have all my land as Aforesaid after her Mothers death, to her and the heirs of her body Lawfully Begotten, and for want of such Issue to my Daughter Betty Bird and the heirs of her Body Lawfully Begotten and for want of such Issue to Daughter Joanna Bird and the heirs of her Body Lawfully Begotten and for want of such Issue, to my eldest daughter Sarah Bruce and the heirs of her Body Lawfully Begotten, and for want of such Issue to Go and Descend to Job Tillery's proper heir at Law my said Land above given to my Daughters for want of my son his having issue, I value to be worth Four Thousand Pounds of Tobo. I therefore order that which Ever of my four Daughters shall happen to Injoy my said Land as Aforesaid she so Inheriting is hereby Obliged to pay her sisters their proper Shears (sic) of the value I have here set upon my Land.
Item. I Give and Bequeath all my other Estate of what nature of kind soever to my Loving Wife Mary for and during her Natural life and after her death of be Equally Divided amongst my Surviving Children and lastly I nominate and appoint my well beloved Wife my whole and sole Executrix of this my last Will and Testament Revoking and disannulling all other Wills whether Verbal or written by my heretofore made.
In Witness whereof I have hereunto sett my hand and fixed my seale this 2nd day of January 1751/ Phillomon P Bird his mark and Seale. Sign'd, Seal's and Published in presence of Danll x Jackson, Thomas Samford, Job Tillery. Prob. 2 March 1752.

Came Phileman BIRD, Thomas Starke, Jos. Ferguson, Henry Eastham, Henry Coleman Jr., Henry Coleman Sr., Wm. Walton, Henry Gresham, Thomas Watts, Thos. Carlton, Wm. Good, Edwd Carlton, Geo. Gresham, Wm. McDuff, John Row, Ambrose Gresham, Arthur Watts, Edwd Watts, John Holcombes, Con. Smith, ROBT ARMISTEAD BIRD, John Hemingway, John Hayerton, Sam'l Smith, Ge. Richards, Wm. Phelps, Jos. Rogers. Produce in court a petition into Widdow Smith's Roleing Road. To be laid off in passing from Rapahanock and Mattepony Rivers. It will run through the middle of Widdow Smith's plantation. Mr. Bird offered to take a road or briddle way where she would lay it off herself, provided she would do it in such manner as could pass to Mr. Heard's line. May Court 1744. Ordered that the road as before mentioned ought to be established according to the Pet. of the said Philomon BIRD and others. From which judgement the said Ann Smith appealed, together with Alexander Parker, her security.

KNOW ALL MEN by these presents that we PHILEMON BYRD & PHILIP JONES are held & firmly bound unto THOS. WARING, THOS, JONES, BENJA. WINSLOW & WM. ROAN Gent Justices of the County of Essex in the sum of one hundred pounds Sterling witness our hands & seals this XVth day of February MDCCXXXVI
THE CONDITION of this obligation is such that if ye above bound PHILEMON BYRD Guardian of JOHN HAYNES his heirs shall well and truly pay or cause to be paid unto ye sd Orphan all such Estate or Estates as now is or hereafter shall come to ye hands of ye sd PHILEMON as soon as ye sd Orphan shall attain to lawfull age or when thereunto required by the Justices of the peace of the County of Essex as also to save & keep harmless the sd Justices from all trouble that shall or may arise about the sd Estate then this obligation to be void & of none effect . .
