      THIS INDENTURE made the Nineteenth day of November in the year one thousand seven hundred & thirty nine Between ANDREW HARDEE & JANE his Wife of the Parish of Southfarnham in the County of Essex of one part and THOS. SMITH of the Parish of Southfarnham & County of Essex of other part WHEREAS RICHARD HUTCHINS late of the said Parish & County deced was in his life seized & possessed of a plantation & parcel of land being in the Parish & County aforesaid containing one hundred & Seventy seven acres being bounded by the Lands of MR. EZENEZAR ADAMS, HUGH WILLIAMS & FRANS. PAIN, which by his Last Will and Testament bearing date the 21st day of May 1720 among other things mentioned did give his said Land to his Wife REBECCAH HUTCHINS (now Wife of the said THOMAS SMITH) for and during her life and after her decease he gave it to the Child she was then with Child if a male child to him & his heirs if a female to her & the heirs of her body lawfully begotten & if the said Child should die without heir then he gave ye said Land to his Sister in Law JANE WILLIAMS and her heirs forever the said Child being dead & dying without heir Right of the reversion & remainder of the said land is now in the said JANE (now wife of the said ANDREW HARDEE) who is desirous for the consideration herein after mentioned to grant & confirm unto the said THOS. SMITH (who is in the actual possession thereof) one half of the said land being Eighty Eight acres to him, his heirs & assigns forever, Now This Indenture Witnesseth that the said ANDREW HARDEE and JANE his Wife for the sum of Fifty pounds current money of Virginia to them paid by said THOMAS SMITH have granted unto said THOS. SMITH and to his heirs & assigns all that plantation or parcel of land whereon said THOMAS SMITH now lives containing Eighty eight acres bounded Begining at a Corner Black Walnut standing in Mk ADAMS's line & runing by a line of marked trees to a Sassafras Stake drove in the ground for a Corner in the old field from thence by a line of marked trees until it comes to a nother line of said ADAMS's being bounded by his the said ADAMS's land and the land of HUGH WILLIAMS and FRANCIS PAIN To Have and To Hold the said Plantation & all the premises unto the said THOS.       of land being in the Parish of Southfarnham & County of Essex Containing Eighty eight acres of land bounded Begining at a Corner Black Walnut standing in Mr. ADAMS's line and tuning thence by a line of marked trees to a Sassafras Stake drove in the ground for a corner in the old field thence by another line of marked trees to the said ADAMS's line being bounded by the said ADAMS line from thence to the beginning, To Have and To Hold all the said Plantation with all appurtenances unto the said ANDREW HARDEE & JANE his Wife forever so that neither they the said THOMAS SMITH &REBECCAH his Wife nor their heirs or assigns nor any other person for them or in their names will by any ways or means hereafter have Claim or demand or Interest of in or to the premises they and every of them shall be utterly Excluded & barred forever by these present, In Witness whereof we have hereunto set our hands & fixt our seals this XIXth day of November MDCCXXXIX
