      THIS INDENTURE made the Ninth day of March in the yeare of or: Lord God according to the computacon now used in the Church of England One thousand seven hundred & one Betweene PETER HARWOOD of the Parish of South Farnham in the County of Essex within the Colony of Virginia, Planter (only Son & heire apparent of MARTHA HARDING late of the same Pish. County & Collony), of the one part & FRANCIS MOORE of the Parish of Cittingburen in the County of Essex within the Collony of Virginia aforesd., Merchant, of the other part. Witnesseth that for Six thousand pounds of good sound merchantable tobo: and Thirty Shillings current money unto the said PETER HARWOOD hee hath granted unto the said FRANCIS MOORE his heires and assignes forever all that tract of land conteyning One hundred twenty and five acres being in the Pish: of South farnham & County of Essex aforesd. formerly called RAPPAHANNOCK County upon the South side of Rappahannock river late in the tenur & occupacon of WILLIAM HARDING deced & bounded as followeth. Beginning on PISCATAWAY CREEKE at the mouth of a little Creeke comonly called CAPLES CREEKE, thence runningup the sd CAPELLS to the head cornering at a little read Oak in the Antient Lyne that is adjoyning to the land of THOMAS GREENE, runing alongst that side line to the Maine Creeke unto the mouth of CAPELLS LITTLE CREEKE to the place where itt first began with all & singular its rights members & appurtemts. together with all houses & structures thereon being & all orchards gardens yards woods to the said land belonging which said tract of land is part of a Devidend of Two hundred & fifty acres of land formerly granted to JOHN CAPELL deced by Patent beareing date ye 4th day of Octobr: 1653 And afterwards upon Peticon of REBECCA CAPELL, Widow of the said JOHN CAPELL deced, was granted & confirmed to the said REBECCA & her heires by order of the Govr. &, Councell dated ye 24th of March 1661, And afterwards granted unto JOHN BULLEN, Son & heire of the said REBECCA CAPELL by Patent beareing date ye 26th day of March 1664. & afterwards was together with 83 acres more in all 333 acres granted unto MARTHA HARDING, Sister & heires of the said JOHN BULLEN by Pattent beareing date 21st day of Octobr: 1687 & now doth of right belong unto the said PETER HARWOOD as only Son & heire apparent of the said MARTHA HARDING and the sd land with all rights of him the said PETER HARWOOD To have & to hold to the only proper use of said FRANCIS MOORE his heires & assignes forevermore hee paying the Rent & performeing the services which shall grow due unto or: Sovegne: Lord the King and the sd PETER HARWOOD will warrant the said Land att all times without any interuption of said PETER HARWOOD his heires or any other persons clayming under him In Witness whereof the p:ties have set their hands and seales

      7 Aug. 1710. In obedience to orders of 10 July and 10 Aug. 1710, we began to survey the land of the plaintiff
      [never named] ... east side of Coxes Creek ... line of Ralph Payne ... The patent under which the plaintiff claims was granted to John Bullin son and heire of Rebecca Capell and it was before granted to John Capell, deceased, 4 Oct. 1653, and upon the petition of Rebecca the poore widdow the Governor and Councill confirmed the land to her and her heirs by order 24 March 1661. The patent under which the plaintiff claimed was signed 26 March 1664. The patent under which the defendant claimed bear date 15 June 1661. The patent under which the plaintiff claimed ... dividing line between Peter Harrood and Thos. Green.
      We find the defendant John Webb by his own confession fell a timber tree of the plaintiff's. We find John Webb did rent a house of the plaintiff's and did receive from John Callicoat, then tenant to the defendant, one obligation of 200 pounds of tobacco in full satisfaction for the rent and the house was rented before 1 June 1709. If the law be for the plaintiff we find one shilling sterling damages.

      26 March 1664. Sir Wm. Berkeley, Knt., Governor and Captain General of Virginia. Patent to John Bullen, son and heir of Rebecca Capell, for 250 acres in Lancaster County on the south side of Rappa. River and on the eastward side of Copes [Coxes) Creek ... on the upper side of 100 acres formerly surveyed for Dan: Batts ... land of Ralph Payne ... formerly granted to Jno. Capell, deceased, by patent 4 Oct. 1653 and upon the petition of Rebecca the Poore widdow the Honorable Governor and Councell confirmed the land to her.
