      At a Court held for the said County the 24th day of February 1719.
      ANN HIGGINS relict of AUGUSTINE HIGGINS, Gent. decd. came into Court and made oath that the said AUGUSTINE departed this life without making any Will so farr as she knows or believes and upon her mocon Certificate is granted her for obtaining Letters of Admicon on the said Deceds. Estate in due form JOHN ELLIOTT, GEORGE ESKRIDGE, Gent. assuming to be security for her faithfull admicon according to law.
      Ordered that JOHN CHILTON, Gent. HUMPHREY POPE, JOHN WADDEY & JOHN ELLIOTT or any three of them being first sworn before one of his Majesties Justices for the said County do some time before the next Court to be held for the County aforesaidvalue and appraise the Estate of the said deced. in money and make report thereof tothe said next Court.

      ELIZABETH HIGGINS, Widdow, haveing sworn the peace against ANNE HIGGINS, Wife of AUGUSTINE HIGGINS, and alsoe against JONE DANIEL, Wife of RICHARD DANIEL, all of this County, and JOHN CHILTON, Gent., one ofher Majties Justices for this County, at ELIZABETH HIGGINS's Complaint haveing bound ANNE and JONE to keep the peace of our Soveraigne Lady the Queen by the space ofone whole yeare and returned the Warrant together with their recognizance to this Court, it is ordered the same be lodged in the Clerk's Office for this County

      THIS INDENTURE made this Seventeenth day of February in the Twelfth yeare of the Reign of our Sovereigne Lady Anne by the grace of God of Great Brittaine France and Ireland. Queene defender of the faith, and in the yeare of our Lord one thousand seven hundred and Thirteen, Betweene AUGUSTINE HIGGINS of County of WESTMORELAND of one part and HENRY GOLLOP of County of Richmond of other part; Wittnesseth that AUGUSTINE HIGGINS for the sume of Five shillings Sterling to him in hand paid by HENRY GOLLOP. do by these presents bargaine and sell unto HENRY GOLLOP his heirs a certaine tract of land containing One hundred and Ten acres lying on DEEP RUN about twelve miles above the FALLS of RAPPAHANNOCK RIVER in county of Richmond and bounded Begining att. a marked Gum tree standing at the mouth of ye said DEEP RUN on the upper side thereof and extending thence West one hundred poles along the said River side and thence still by the said River side North West one hundred and eighty poles to a marked Beach tree standing on the River side, thence North East fifty poles into the Woods to a marked Pine scree, thence South sixty degrees East two hundred and sixty poles to a marked Hickory standing by DEEP RUN then dowse ye Run South West to the begining Gum. containing One hundred and Ten acres of land which sd. land was formerly granted to JOHN and AUGUSTINE HIGGINS ioyntly by Patent from the Proprietors Office bearing date the Tenth day of March one thousand seven hundred and Six and now since ye decease of ye said JOHN HIGGINS the whole tract, of land descends to AUGUSTINE HIGGINS, party to these presents as Sun and heir of the aforesd. JOHN HIGGINS. Together with all Dwelling Houses out houses tobacco houses gardens barnes orchards and meadows belonging; To have and to hold the tract. of land with the appurtenances to the same belonging unto HENRY GOLLOP and his assigns from the date hereof during the full term of one whole year paying therefore the Rent of one Silver Six pence if lawfully demanded to the intent that by virtue of these presents and of the Statute for the ransferring of uses into possession the said HENRY GOLLOP may be in the actual possession thereof and thereby enabled to accept

      IN THE NAME OF GOD, Amen, I THOMAS BARNES of the County of Westmoreland in the Coloney of Virginia being sick of body but of perfect sence & memory & calling to mind the uncertainty of this life, do prepare make & declare this my Last Will &Testament in manner & form following, Imprimis. I resigne and recommend my immortall Soul into the hands of my blessed Saviour and Redeemer Christ Jesus in firme hope & beleife throw his meritorious death and passion to receive pardon & forgiveness of all my sines & a joyfull resurrection att the last day to eternell bliss and happiness and for whatt worldly Estate God in the abundance of his Mercy hath been pleased to allow me, I dispose theireof throw his permission in manner & forme following;
      Item. I give & bequeath to my Loving Wife, ANNE BARNES, those five Negroes as namely Prince, Achee, Clarke, Goodded & Jack to her & her heirs for ever;
      Item. I give all the rest of my Negroes & their Encreas to my three Children, namely ABRAM, ELIZA: & FRANCES to be equally divided among them;
      Item. I give to my Loving Wife, ANNE BARNES, one forth part of all my moveable Estate to her & her heirs for ever;
      Item I give to my Loving Wife, ANNE BARNES, one forth part of my part of all my Copper Mine or Mines which is on the Land I purchased of WILLIAM MACKBEE during her naturall life;
      Item. I give to my Loving Brother, ABRAM BARNES, ten thousand pounds of tobacco together with my two Servant men as namely THOMAS CHITLEE & JOHN WALTER & my Horse called Maryland;
      Item. I leave all the rest residue & remainder of my personall Estate to the discression of my Exrs., RICHD. & ABRAM BARNES, till they see fitt to lay itt out in Land & Negroes for the good of my three Children, ABRAM, ELIZA; & FRANCES, & that my Dafters have their partes as they severally attain to the age of Eighteen or married & thatt my Son have his Estate when he attaines the age of twenty one;
      Item. I give the one halfe of my Land thatt lies in SHUGERLAND NECK to be equelly devided between my two Dafters to hold to them & theire heirs for Ever:
      Item. I give the rest & remainder of my Land to my Son, ABRAM BARNES, to him & his heirs for ever; And I do heareby appoint my Loving Wife. ANNE BARNES and my Loving Brothers, RICHARD and ABRAM BARNES, Executrx. and Eztrs. of this my Last Will & Testament, And do heareby revoke all former & other Wills by me maid & I do declare this & none other to be taken for my Last Will & Testament; In Witnes whereof I have hearunto sett my hand & seale this 28th day of November 1728
