      W. W. 7 May 1781---W. P. 10 December 1781
I do not consider myself indebted to the estate of the late John Yerby, for the land and other things I purchased of him.
I confirm my late precious daughter Margaret Smith's will, in every part of it. That the negroes Joe, and Joshua, and black George(son of Sarah), pass thereby, the first two I long since sent to Middlesex, the other I gave her for raising him and saving him from death by her own personal care. Also two mares, the gray one called Polly, and the bay called Phillis, which I let her have in the autumn of 1774, and they have remained in Middlesex at "Shooters Hill," the gray 'till last spring, the bay 'till this, having brought them over for more care, the overseer not taking good care of them, and the increase to go with the mares.
Grandson Augustine Jacqulin Smith, son of my said daughter-all the lands in Fairfax County which I purchased of John and George Yerby, to him and his heirs lawfully begotten of his body, and for want of such to David McCullock, son of John McCullock of Torhouse, and Mary his wife, my youngest sister of the shire of
Wigton in North Britain, and the lawfully begotten heirs of his body, and should he die before me, to James McCullock, son of John McCullock and Agnes his wife, late of the Isle of Man.
To grandson with the same remainder, a small tract of land in Fairfax County containing about twenty acres, which I lately patented, and joining the other tract.
To grandson-my land in Loudon County, to him and the heirs of his body.
Grandaughter Mary Jacqulin Smith-my dwelling plantation, and a small tract of land I purchased of the widow of John Nichols, the land Henry Self now lives on.
Two thirds of my slaves to my above grandson.
One third of my slaves to my above grandaughter.
Grandaughter-to have all my plate, because her mother gave her brother Augustine, her plate.
Grandaughter-my gold watch, chain, hook and. seal, in gold.
I promised my daughter a gold watch, and suitable furniture, which I now order to be bought at the expense of my estate, and which I give to my grandaughter,
Grandson-my books, and my musket which I long since gave him.
Wife-use of my home plantation and where Henry Self now lives, and the negroes thereon except Eve, Jesse, and a yellow fellow George the Carpenter, as they are at present boiling salt with Peter Cox as by agreement, and as many black cattle as she can maintain vizt: ten cows and calves, four yoke of oxen, ten barren young cattle, all the stock of hogs and sheep and horses, present years crop, provisions in the house udring her natural life or widowhood, also use of land I rent of Robert Carter, Esq., of "Nominy Hall," except the part I rented to Frances Walker, use of my gold watch, hook chain and seal, during her widowhood, and a neat plain chariot with harness, be purchased for the use of my wife and grandchildren.
My estate in."North Britain" to my sister Mary McCullock, and her eldest surviving son and his heirs, and to the eldest child, male or female, of my late sister Agness McCullock.
      Grandaughter-to be gentelly educated.
Grandson-may be brought to the profession of a physician and liberally educated, and to be sent to Scotland for that purpose, to one of the colleges in Aberdeen for his academical studies, and then to Edinburgh to complete his medical studies, and he to visit London, Ligden, and Paris, before he leaves Europe.
My wife having perused my will, and not being satisfied, I hereby void every gift to her.
Rest of my estate real and personal-to my two grandchildren and their heirs, and if either should die without heirs, to the survivor, and if both die before marriage or arriving to the age of twenty one, I give my whole estate to my two sisters Agnes McCullock, and Mary McCullock, and their heirs.
My land in Loudon County containing fifteen hundred acres,(but the courses will give seventeen hundred and fifty acres), for tobacco rent 'till grandson comes of age.
The heirs of Colonel John West of Fairfax County, to be sued for the high land and Pocoson joining on Potomack River, Fairfax County. The said West took away twenty acres of high land, including a little pocoson, tho the jury found it against him.
Philip Alexander, and the papers I have, will give light into this dispute.
The ten acres Thomas Marsh promised me in presence of his Cousin Charles Marsh, adjoining the land I bought of Betty Nicholls- to my grandaughter.
Grandson to carry my bones, those of his mother, and his Uncle Alexander Boyd, to Scotland, and have them buried by my father and mother in the churchyard of the Town of Wigtown, and my executors and his guardian to pay the expence out of my estate.
Colonel John Smith of Frederick County, the Reverend M. Thomas Smith of Westmoreland County, guardian to my grandchildren, and with Richard Mitchell of Lancaster County, Captain David Ball and Onesiphorus Harvey of Northumberland County, John Sydnor, Captain Williamson Ball, William Miskell, and Major Charles McCarty of Richmond County, and William Taylor of Northumberland County, executors.
      No witness.
Presented in Court by the widow Margaret Boyd, the executors refusing to act, administration granted to the widow.
