      THIS INDENTURE made this 10th day of April in the year of our Lord 1688 in the forth year of the Reigne of our Sovereigne Lord James the second &c. Between CUTHBERT POTTER of MIDLESEX COUNTY and Dominion of Virginia Gent. and EDWARD LEAMAN, Citizen and Tallow Chandler of London, of the other part Witnesseth that the sd CUTHBERT POTTER in consideration of One hundred and Fifteen pounds Nine Shillings of Sterling money of England to him paid hath granted unto the sd EDWARD LEMAN his heires and assignes forever all that tract of land being in the Freshes of Rappa: River and on the North side of the same buting and bounding as followeth Beginning at a Palukery Tree standing by the River side alittle above TALIAFERROS MOUNT and turning thence N. W. to a Stake by a corner Locust, thence S. S. E. to the River and lastly up the River to the place it begun being Four hundred acers and part of a Pattent of Five thousand two hundred seventy and five acers granted unto THOMAS CHETWOOD Gentt. and JOHN PROSSER, Plantr., bearing date the 28th day of Sept. in the year of our Lord God One thousand six hundred Sixty and seven and division thereof made between the said CHETTWOOD and PROSSER by Deed Indented bearing date the Six and twentieth day of July in the abovesd yeare next before having the said land entered and surveyed and devison thcrcof had and made between them as aforesaid part so devided belonging unto the sd CHETWOOD the sd CUTHBERT POTTER hath purchased by Deed of Bargaine and Sale bearing date the 14th day of November in the year 1668 and in which Devident or part of land the above granted Four hundred acers is conteyned with all manner of profitts and appurtenances whatsoever in anywise belonging To have and to hold the sd Four hundred acers of land and all the premisses unto the sd EDWARD LEAMAN his heires to the only use and behoofe of him and his heires forever, Provided alwaies nevertheless that if the sd CUTHBERT POTTER his Exrs. or assignes or any of them shall well and truly pay unto the sd EDWARD LEAMAN the sum of One hundred and fifteen pounds Nine Shillings Sterling money of England by good and sufficient Bills of Exchange payable unto the sd EDWARD LEAMAN within seven yeares next ensuing the date hereof or otherwise to the satisfaction of the sd LEMAN without covin or further delay that then and from thence forth this present Indenture of Bargaine and Sale shall cease and be utterly void and that then it may be lawfull also for the sd CUTHBERT POTTER to have againe and repossess and the sd CUTHBERT POTTER doth for himselfe his heires that if upon the Survey of any elder Pattents any part of the sd premisses shall happen to be taken away by any such Elder Patent then he the sd POTTER shall make good and lay out for the said EDWARD LEAMAN so much of the like quantitie of the sd Devident near and adjoining to the aforesaid granted as any such Survey or elder Pattent shall happen to take away, and also that the sd CUTHBERT POTTER is and untill a good and perfect Estate shall be made of the said Premisses unto the sd EDWARD his heires shall continue and be seized of all the before mentioned pre- misses and also that if the sd sum shall happen to be behind and unpaid within the time limitted that the sd EDWARD LEMAN for himself doth grant with the sd CUTHBERT POTTER that it may be lawfull for the sd POTTER to enjoy the before mentioned premisses until Default of payment of the sum of money beforementioned In Witness whereof the parties have set their hands and seales the day and year first mentioned
