      N THE NAME OF GOD, Amen, I JOHN SMITH of ye County of Essex being sick and weak in body but of sound & perfect memory praised be God for ye same, and calling to mind ye uncertainty of this transitory life and that all flesh must yield unto death when it shall please God to call, do make constitute & ordain this my last Will & Testament in manner & forme following
      Imprimis I give & bequeath my soule to God that gave it, in sure & certaine hope of a joyefull & glorious resurrection at ye last day, and my body to ye earth from whench it came to be decently interr'd after my decease; And for my Temporal Estate I give & bequeath as followeth, my will & desire is that my loveing Wife, JANE SMITH, possess & enjoy all my lands houseing & orchards untill my Son, JOHN SMITH, shall attaine to ye age of twenty one years except ye land which I formerly sold for ye use of ye County to build a COURT HOUSE upon, and doe hereby acknowledge ye same to ye afsd. use of the County forever as it is now bounded
      Item I will & bequeath unto my Son, JOHN SMITH, when he shall attaine ye age of twenty one years all my lands, houseing, fencing & orchard to him & his heirs forever, And if in case my Son dye without heirs, then I give and bequeath ye same unto JOHN SMITH, Son of THOMAS SMITH, to him & his heirs for ever
      Item. It is my will & desire that my Son, JOHN, as soon as he is capable of Learning be put to schoole & brought up to write and cast accounts
      Item: I give & bequeath unto EDWARD DANIELLIN two Cowes, two Calves, one young mare and one hogshd. of tobo:
      Item I will & bequeath unto MARY GANNOCKE, Daughter of WILLIAM GANNOCKE, two Cowes, two Calves & one young Mare at her Marriage day
      Item I give unto SARAH CLARKE, Wife of JOHN CLARKE, one Cow to be delivered when my Will is prov'd
      Item I will unto Mrs. MARY THACKER one gold Ring about twenty Shillings price
      Item As to ye rest of my personal Estate, my will & desire is that my Wife, JANE, have two thirds, and my Son, JOHN, ye other third, And if in case my Wife, JANE, doe dye before my Son, JOHN, attaine to be capable of manageing his Estate, my will is that Mr. SAMUEL THACKER & his Wife do take my Son and his Estate into their Custody & possession dureing his minority
      Lastly I make & ordaine my Wife, JANE, sole Executrix of this my last Will & Testament & do request my loveing friends, Mr. SAMUELL THACKER and JOHN GRAVES to see this my Will be duely p:formed In Testimony whereof I have hereunto put my hand & seale this 9th. day of Xbr: 1694

      ROBT. BROOKE, aged forty yeares or thereabouts being sworne saith that he saw ye within named JNO. SMITH signe seale & publish ye within sd Will to be his last Will & Testamt: & that he was in perfect sense & memory at ye doeing thereof to ye best of yr: Deponants Judgmt. And further saith not, sworne to in Essex County Court ye 11th day of Febry: 1694 RO: BROOKE
      SAML. THACKER aged 38 years or thereabouts being sworne saith that he saw ye within named JNO: SMITH signe seale & publish ye within written Will to be his last Will & Testamt: and that he was in perfect sence & memory toye best of ye Deponts: Judgment and further saith not. Sworne to in Essex County Court ye llth day of Febry: 1694

      KNOW ALL MEN by these presents that I ye within named PETER JONSON doe hereby assigne over all my right & demand of ye wthin mentioned conveyance of Two hundred acres of land wth all ye Rights that to me is granted, wth all additions of buildings or other conveniences since my purchase of ye same unto WILLIAM GANNOCK of Rappae County his heires & assignes To have and to hold use & enjoy ye sd land to him ye sd WILLIAM GANNOCK his heires & assignes wthout ye lett of me ye sd PETER JONSON my heires or assignes during ye tearme & for ye acknowledgemt, wthin mentioned I having received a valuable consideration for ye same, And I doe obleidge my selfe to acknowledge ye sd Two hundred acres of land either by my selfe or my Certain Attorney when thereunto required, by ye sd WILLIAM GANNOCK in ye County Court of Rappae, In Witness whereof I have hereunto sett my hand & seal this 5th day of September 1677

      KNOW ALL MEN by these prsents that I ROBERT THOMLIN of Rappae. County wth ye consent of REBECCA, my Wife, for ye consideracon of two thousand pounds of tobacco in hand to uspaid, Doe acknowledge to have sold from us & or: heires forever unto ROBERT PARKER his heires & assignes for ever a certain quantity of land being in Rappae: County & on ye North side of Major JNO. WEIREs MILL by Estimation Sixty acres more or less bounding upon ye land of WILLIAM JEWILL, HENRY MONCASTER & JOHN WEIRE. Now Know yee that I ye said ROBT. THOMLIN doe acknowledge to have sold ye land herein mentioned from me & my heires forever in as large & ample manner as is expressed in ye Pattent whereunto this hath relation, warranting ye sd land from all Claymes of GEORGE JONES his heires & assignes to save & defend, And I obleidge my selfe to acknowledge this at any Court that shall be holden for Rappae. County wth ye like acknowledgmt. of REBECCA my Wife, And for confirmation hereof I hereunto together with my Wife sett my hand & Seale this 2d of January 1675/6 Signed Sealed & delivd. in prsence

Attorney for mee & in my place & stead to acknowledge my right of a parcel of land to ROBERT PARKER as by a Deed of Sale doth appeare, & for ye true performance of all ye prmises, I have hereunto sett my hand & Seale this 5th day of March 1677/8
