Gent. his heirs a certain tract of land containing Seventy and four acres which my Father, WILLIAM GRIFFIN deced. purchased from JAMES JACKSON situate lying and being in County of Rappa: on North side of the River about half a mile back of JAMES ORCHARDs Plantation begining at a Maple in a Great Swamp and runing thence East to a Stake by two small red Oakes neere an old field, thence W. cuting over a main branch to a Stake by a Hickory and a small Walnut, thence W: S: to another Stake upon a Hill side by a Hickory, thence S: East to the first mentioned Maple; To have and to hold occupie and enjoy the aforesd. Tract of land by him said JAMES HARISSON his heirs with all houses, orchards fences and all other appurtenances and hereditaments thereunto belonging or anywise appertaining without the lett interruption eviction of me my heirs or Admrs, or any other person whatsoever only the aforesd. Planter, for the sum of Four thousand five hundred pounds of good tobacco in cask for which I have received caution, have sold unto JOHN KING of the Parish and County aforesaid and his heirs forever the Plantation whereon I now live with all lands houses fences and hereditaments thereunto belonging in as large a manner as it was granted to me by two Deeds, one from WILLIAM GRIFFIN for about Twenty acres more or less, and the other for about Ten acres more or less purchased of JAMES ORCHARD, bounded as the several Deeds make mention relation being thereunto had may appear, To have and to hold the aforesaid Plantation lands houses fence and all other appurtinances belonging to him the said JOHN KING his heirs and assigns forever without any lett or eviction of me the said JACKSON my heirs, And I the said JAMES JACKSON do hereby warrant the sale of the premisses unto the said JOHN KING and his heirs forever from the claim of all persons whatsoever, I the aforesaid JAMES JACKSON do hereby oblige myself to acknowledge this Deed within Six months after the date of these presents in the County Court of Richmond that it may be there enrolled according to Law, And that I will cause my Wife to do the same either by herself or lawfull Attorney.       KNOW ALL MEN by these presents that whereas I the Subscriber have purchased of JAMES JACKSON his Plantation and the Land thereunto belonging and have a Deed confirmed for the same, Now Know ye that notwithstanding the said Conveyance I do hereby agree and consent that the said JACKSON shall keep and enjoy the Dwelling House (excepting the Loft) two years and shall have Corn Ground within the Fence for Two thousand Hills and Ground for a Kitchen Garden, also Liberty to gett firewood and to keep and raise what Stock of Cattle and Hogs he shall think Fitt during the time aforesd and no longer, Also I do further agree and consent that if it should please God that I die before that I have fully paid for the said Plantation and my Wife incapable of paying for the same that then the Planation shall revert to the said JACKSON his heirs or assigns the said JACKSON reimbursing the said KING his Executors and Administrators what. tobacco shall he paid towards it (if any) only reserving Five hundred pounds of tobacco for every year that I shall live upon the Plantation; ; Lastly I do agree and covenant that if I make default in the paymt, of Four thousand five hundred pounds of tobacco in two years. That then in such case I am obliged to pay the said JACKSON or his assigns Five hundred pounds of tobacco as Rent till the whole sum is fully paid and satisfied.       - JAMES JACKSON of the County of Richmond, Planter, was summoned to answer PITHAGORAS POWELL that he hold to him Covenant between them made according to the force form & effect of a certain Instrument of Writing or Deed Poll by him the said JAMES JACKSON made signed sealed & delivered as his act and deed the 2nd day of May 1690 and afterwards, that is to say, the said Deed did acknowledge in the County Court of RAPPAHANOCK the 7th day of the said month of May 1690, in which said Deed or Instrument of Writing the said JAMES JACKSON hath for a valuable consideration as is expressed bargained & sold unto the said PITHAGORAS POWELL and to his heirs & assignes forever a certain tract of Land containing Seventy and one acres as by the said Deed or Instrumt. of Writing and here in Court ready to be produced doth and may more fully and at large appear, And the Plantiff in fact saith that amongst other things in the said Deed contained is a particular Covenant of General Warranty of the aforesaid bargained & sold Lands entered into by the said JAMES JACKSON unto the said PITHAGORAS POWELL his heirs or assigns forever, from the claim title or interest of all persons whatsoever notwithstanding the said JACKSON well knowing that he had neither right nor title thereto but craftily & sublilty the Plantiff to defraud & deceive his said Covenant hath broken and not all mended or regarded nor by force of the sd Warranty tho: Often thereunto demanded and required hath not rendered to the Plantiff any manner of restitution or satisfaction for his damages sustaianed which he saith is to the value of Four thousd pounds of tobacco whereupon he hath brought this action & prays Judgment
      with costs &c., and the said PITHAGORAS producing an accot. of Thirteen hundred & thirteen pounds of tobacco which he evidently made appear that he was out in suing forth a Conveyance from the PROPRIETORS OFFICE for the said Land & other incident charges thereunto belonging & for that the Defendant hath nothing to offer in bar thereof, the Court have ordered that the said JAMES JACKSON do pay unto the said PITHAGORAS POWELL the said tobo; together with cost of suit alias Execution
