      Elley & wife to Pope Indenture
      This indenture or deed of feoffment made this 20th day of April 1769 between Henry Elley, Jr., of the county of Spotsylvania, tavern keeper and Sarah Elley his wife of the one part and Thomas Pope of the County of Fauquier of the other part. Witnesseth that Henry Elley, Jr., and Sarah Elley his wife in consideration of 10 pounds current money in hand has sold unto Thomas Pope a tract of land containing by estimation 274 acres lying in the Great Fork of Rappahannock River in the County of Culpeper being apart of the Fox Mountain tract formerly granted to Charles Stewart by patent bearing date the 21st day of August 1734 and is bounded as follows; beginning at three white oaks on the north side of a branch of Cedar Run in a supposed line of John Spotswood, Esq., deceased, and running thence up the said branch 350 poles to two white oaks near a large rock on the north side of the said branch, thence leaving the said branch North 24° 30 minutes West 126 poles to a white oak in a valley, corner to a part of the said patent claimed by Thomas Covington from Joseph James, thence East 44 pole to four white oaks and a locust on the West side of a branch of Hungry Run, thence down the said branch the several courses 252 pole to two dead white oaks on the main branch and north side thereof of Hunger Run at Bloodworth’s Road corner to Samuel Henning (now Daniel Brown, Gent, thence down the said road South 55° East 134 pole to three pines in Spotswood’s line at the fork of Field’s Road, corner to James, thence with that supposed line of Spotswood’s South 28° West 187 pole to the beginning. In witness whereof the said Henry Elley, Jr., and Sarah Elley his wife have hereunto set their hand and seals the day and yeare first above written.

      At a court held for the County of Culpeper on Thursday the 20th day of April 1769 this indenture of feoffment from Henry Elley, Jr., and Sarah Elley his wife to Thomas Pope together with the memorandum and receipt endorsed was acknowledged by the said Henry and ordered to be recorded; and at a court held for the said county on Thursday the 15th day of June 1769 the said Sarah came into court and relinquished her right of dower to the within mentioned land.

      This Indenture made 15th October 1770 between HENRY ELLEY of County of Culpeper Founder and ESTHER his wife and their Son HENRY ELLEY JUNR. of said County and Colony & SARAH his Wife of the one part and THOMAS POPE of the County of Fauquire in Colony aforesaid of other part ., in consideration of sum Fifteen pounds Ten shillings current of Virginia have granted unto Thomas Pope 175 acres in the Great Fork of the Rappahannock River being a part of a greater parcel belonging to the said Elley a purchase by him made of GEORGE HUME Decd known by the name of the Fox Mountain Tract and is bounded Beginning at three white oaks on the North side of a branch of Cedar Run in a line of Spotswood Esqr. running thence with his line corner to a parcel of land sold out of the said Elley's to Foster or Wood in the said Spotswood's line thence to a white and red oak in HENRY ELLEY JR. line crossing over first branch of Cedar Run to two white oaks near a large Rock corner to another tract belonging to Thdmas Pope to the beginning

      THIS INDENTURE made 9th Septr. 1776 Between BOWLS ARMISTEAD of one part and HENRY ELLY of other part Witnesseth that said Bowls Armistead for rents and Covenants herein after mentioned hath granted to farm letters unto said Henry Elly 137 acres of land Except mines minerals and Quarries in County of Culpeper and Parish of St. Mark on the North side of the Rappadanne River part of a Tract of land of 40,000 acres left to ALEXANDER SPOTSWOOD Esqr. by his Grand Father bounds of which are described by a plott and Survey Endorsed on the Back of this Indenture To Hold the said land except before excepted to Henry Elly during the Natural lives of SARAH ELLY THOMS. ELLY & HENRY ELLY JUNR. for and during the natural lives of the longest liver of them paying yearly on the twenty fifth day of December Seven hundred and Eighty five pounds of Tobacco and Henry Elly doth covenant that said Henry Elly or his assigns will four years after the date of these presents plant 300 fruit trees one third at least be good apple trees, and same well inclosed in fence and that it shall be lawfull for said Bowls Armistead to enter and there to dig for any mines of stone, Iron, Lead Copper or other mines & to have free Ingress Egress &Regress makeing full recompence to Henry Elly for such loss as he shall sustain by reason of the diging . . . .
