      At a Court held for Essex County 10th of June 1692
      - Capt. EDWARD THOMAS brought his accon to this Court against RICHARD TALBOT, And by his Complaint sett forth that the said TALBOT being in your Complainants Debt did order a hogshead of Tobo: of the Plantacon of Mr. JAMES BOWLER, where sd TALBOT made his crop last year, your Complainant expecting some fraud in the case sett down on said Hogshead only weighed, And caused it to be rowled to another House on the same Plantacon, where your Complainant resolved to cause all the Tobo: to be taken out of the said hhd., so to tare the Caske, which accordingly was done where yor: Complainant found that the said RICHARD TALBOT did sett down and counterfeit the Coopers Marke false tare and false pack, the sd hhd: Tobo: haveing put in between every two layrs. of Tobo: ground leaves, stalks, stones and the sweeping of the Tobo: House, which the Complainant is ready to prove, Therefore humbly prayes order that the said RICHARD TALBOT may receive such punishment as the Law in such cases provides
      To which the Defendt. appeared and pleaded not guilty, And a Jury being impannelled and sworn to try the truth of the premisses, who (Vitt) Mr. RICHARD COVINGTON, Mr. ANDREW HARRISON, Mr. THOMAS GREENE, Mr. WM. LEAKE, Mr. RALPH WHITTON, Mr. RICHARD BUSH, Mr. WILLIAM ACRESS, Mr. JOHN MOSS, Mr. THOMAS HINDS, Mr. RICHARD HOLT, Mr. PHILL: PARR, Mr. JNO. WEBSTER, returned their verdict in these words: This Jury doth find that the Hogshead of Tobo: when it was opened by the Evidences to be false packed, p me RICHD. COVINGTON, which verdict this Court have confirmed, And ordered that the said TALBOT loose the said Hogshead of tobo: and stand fastened to the WHIPPING POST ye space of halfe an hour, and pay all costs
