I THOMAS SMITHER of the County of Culpepour Planter am seeck and weak in body but in pauit mind and membory .. my Body I recommend to the Ground to be buried in a Christian like maner and my Sole to Allmighty God my Creator and Redeemer have in mind to dispose of my worldly estate as folloeth.
Item I give and bequie to my loving Brother JOHN SMITHER one hundred and fifty acres of land lyein on Ockaguan. {mm: Prince William Co. Va}
Item I give and bequie one hundred and ought acres of land lyein in Gloster County on Garden Crike to my loving Brother John Smither,
Item I give and bequie to my loving Brother John Smither one young bay horse.
Item I give and bequie all the rest of my Estate rarel and Pasinwell to my will Beloved wife MARY SMITHER.

The Last Will and Testament of Thomas Smither deceased was proved by the oath of .. witnesses thereto and ordered to be recorded and on the motion of Mary Smither Widow and Relict of the said Decedent who made oath according to law Certificate is granted her for obtaining letters of administration of the Estate of the said Thomas Smither with his Will annexed in due form she having given security as the Law requires.
