      WESTMORELAND COUNTY,VIRGINIA ORDERS 1714-1716
      p. 254 Westmoreland County Court 30th of September 1714
      - DUNKAN &c, v REMY &c. In the Ejectione Finne brought to this Court by Thomas Clay,Lessee of JOHN DUNKAN, Pltf. against WILLIAM REMY admitted Defendant in the stead ofJohn Day for lands and tenements with appurtenances scituate in the Parish of Cople and County aforesaid in the possession of WILLIAM NASH. After severall continuances of the same, the Pltf. and Defendt. at March Court 1714 agreed on the following facts, [vizt] that PETER DUNKAN was possest of the land in dispute in fee; 2ndly that he by his Will in writeing duely proved dated the 9th ofSeptember 1676 devised the same to his Son, WILLIAM, for one hundred acres of land called the "WOODYARD" and willed that if it should please almighty God to take his Sons, MATTHEW, WILLIAM and CHARLES out of this life or either ofthem without heir that then what he had given them in his Will should fall between his Daughters before in his Will named equally which Daughters were ELIZABETH, ANNE, ELLEN and REBECCA as by his Will a true copy whereofis hereunto annexed more at large appeares; 3dly that WILLIAM DUNKAN did depart this life without issue; 4thly that ELIZABETH, ANNE and REBECCA [ELLEN being dead without issue] entered into the lands by vertue ofthe devise and with their Husbands made sale thereof to the Defendt. and are all since dead every one ofthem leaveing and haveing issue liveing, 5thly that JOHN DUNKAN, Pltfs Lessor is heir at Law to PETER DUNKAN the Testator and the point in question is what Estate the Daughters had in the lands in controversie whether an Estate only for life or an Estate of Inheritance in fee, and submitted the same to the Judgment ofthe Court. Upon consideration whereofthe Court are of opinion that the devise of PETER DUNKAN according to the intent and meaning ofhis Last Will and Testament creates an Estate in fee taile in his Daughters aforementioned and noe other; whereupon at the instance of the Defendt. the suit is ordered to be dismist with costs &c.

      THIS INDENTURE made this Thirtieth day of September in the fourth year of the Reign of our Sovereign Lord George the Second, King of Great Britain &c. and in the year of our Lord one thousand seven hundred and thirty, Between PETER DUNCAN, Eldest Son and heirs of JOHN DUNCAN, late of the Parish of Cople and County of Westmorland, which said JOHN was Son and heirs of PETER DUNCAN the Elder, also of said County, deceased, of one part and WILLIAM REMY of the aforesaid Parish and County of the other parte; Wittnesseth that Whereas WILLIAM REMY did in the year of our Lord one thousand six hundred and ninety three purchase of GEORGE HARRISON and ELIZABETH his Wife, and DENNES CORNHILL and ANN his Wife and THOMAS KIRTLEY and REBECCA his Wife, one hundred acres of land, be the same more or less, as by a certain Deed of Release under the hands and seales of GEORGE HARRISON and ELIZABETH his Wife, DENNES CORNHILL and ANN his Wife and THOMAS KERTLEY and REBECCA his Wife dated the third day of February in the year one thousand six hundred and ninety three, by virtue of which purchase WILLIAM REMY entred into the said land and hath ever since possessed the same. Now PETER DUNCAN in consideration of the quantity of fifteen hundred pounds of tobacco to him in hand paid by WILLIAM REMY the receipt whereof he doth hereby acknowledge. hath released and quit claimed unto WILLIAM REMY his heires all such Estate right title and demand that PETER DUNCAN now hath or ought to have in the one hundred acres of land so that PETER DUNCAN nor his heires nor any person claiming under him shall have or claim hereafter any Estate or interest therein but shall for ever hereafter be barred by these presents; In Wittness whereof the parties to these presents have hereunto sett their hands and affixed their wales ye day and year first above written
