Charles County Maryland Will Book B-1, 1782-1785; Page 178. Capt. Gerrard Fowke's Will.
I, Gerrard Fowke Sr, knowing the uncertainty of life and desirous to do my youngest son justice, and being now in good health, do make this my Will.
To my son Roger Fowke - all the land and plantation I now live on, it being part of Poyton manor.
To my son Gerrard Fowke Jr - the rest of my lands, provided he conveys to Doctor Gusts Richard Brown, the several tracts of land I sold to sd Rich Brow [sic] , which was left to him, sd Gerrard Fowke, by his uncle, Robert Hanson, whose estate being considerably in debt, I sold the sd lands to discharge them without petitioning the Assembly for power, with a view of saving some expense. But if sd Gerrard refuses to convey the rights to all the land so sold sd Doctor Brown, or disturbs them in the quiet possession of them so that my estate may hereafter become burdened with the penalty of the deed I gave the afd Doctor Richard Brown, then I give all the lands herein before given to sd Gerrard, to be equally divided among those of my children who may be sufferers (by him or his heirs so refusing or disturbing sd Rich Brown in the possession of the land) in equal proportion to their losing.
To my 3 children, Gerrad, Catherine, & Sarah Fowke - all my personal estate (after my wife's thirds and debts are paid) to be equally divided between them.
I desire that my son Gerrard Fowke may have full power to act in all things relating to my estate as if of the full age of 21 years.
Executrix: my wife Sarah Fowke. executor: Gerrard Fowke.
