      753. CHRISTOPHER BUTLER complaining sheweth that FRANCIS HANMERSLEY Executor of his own wrong of the Estate of MARTHA BARTON who was Executrix of the Will of her Husband NATHAN BARTON stands indebted to the Plt the sum of three thousand three hundred and seventy pounds of Tobacco and cask by a former order of this Worshipfull Court against said Nathan Barton deced which Nathan Barton in his lifetime hath not paid .. and forasmuch as Francis Hammersley did make it plainly appear in this Court that he hath paid as farr as assetts of the Estate of Nathan Barton deced Therefore this ordered that Francis Hammersley of and from this action shall be dismissed and that Xtopher Butler pay costs ..
