      THIS INDENTURE made the Tenth day of Aprill in 1677 and in the Ninth & twen- tieth yeare of the Raigne of or Soveraigne Lord CHARLES the Second Betweene ERASMUS WETHERS of the Parish of Christ Church in the County of Middlesex Marcht. and FRANCES his Wife and FRANCIS LEE of Buttolfe Lane LONDON March: Whereas ERASMUS SNELLING Citizen and Iron Monger of LONDON by his Last Will &Testament in Wrighting proved in the Prerogative Courte of CANTERBURY in LONDON dated the Eighteenth day of January 1671 and did amongst other things give and bequeath as followeth (Vitt). Item I give unto ERASMUS WETHERS now in Virginia Marcht, ERASMUS MADDOCKS of EAST GREENWICH in County of KENT Woodmonger and MARGRIT THOMAS Wife of RICHARD THOMAS of DEPTFORD aforesd Brewer my Grand Children and to their Heires forever all those my severall Tenements being in the Parish of ST. OLANES in SOUTHWORKE equally to be divided between them shaire & shaire alike Witnesseth now This Indenture that said ERASMUS WETHER & FRANCES his Wife for ye sume of Eight hundred pounds of Lawfull money of England have sold all their third part of those Messuages or Tenements at the several rents mentioned (that is to say) One Tenement in the Occupation of JOHN RUSSELL Potter by Lease p Annum Thirty five pounds; one other Messuage in tenure of WILLIAM HEAD Draper by Lease p Annum Thirty pounds, One other Tenemt. in the Occupation of BENJAMIN NEWINGTON pr Annum Thirty pounds Sterling; and one other Messuage in ye occupation of Mrs. MARY CROWDER by Lease Twenty foure pounds p Annum togeather wth five other Tennements wch are not lett by Lease but are now in the Occupation of Six Several! Tenents at the yearely rent of Seaventeene pounds so that ye yearely rent in the whole to One hundred & Thirty Seaven pounds Thirteene shillings Sterling, and the said Messuages are situate in and adjoyneing to a certaine Ally comonly called CHEQUER ALLY in Parish of ST. Whereas the said ERASMUS WETHERS & FRANCES his Wife by there Indenture of date hereof for the Consideration therein mentioned have sold unto the said FRANCIS LEE his Heirs & Assignes all that theire third parte and shaire of all those Tenements & theire appurtenances or Occupations of the Severall persons and at the severall respective yearely Rents hereunder mentioned (that is to say One Tenement in the Occupation of JOHN RUSSELL Potter by Lease p Annum Thirty five pounds Sterling; One other Tenemt. in the Occupation of BENJAMIN NTWINGTON by Lease Thirty pounds Sterling and one other Tenemt. in occupation of Mrs. MARY CROWDER by Lease p annum Twenty ffour pounds Sterling togeather wth ffive other Tenemts wch are not lett by Lease but are now in ye Tenures or occupations of Six Several! Tenants at ye yearely Rents of Seaventeene pounds Seaventeene Shillings Sterling, Soe that ye yearely Rent of the said Tenemts. both in Lease & out of Lease amounted in ye whole to One hundred and Thirty Seaven pounds Thirteen shillings Sterling, All which said Tenemts. are Scituate in neare or adjoyneing to a certaine Ally Commonly called CHEQUER ALLY in the Parish of St. Claues in Southwarke in the County of Surry and all yards Gardens Backsides Waste & Voyde Grounds Lights Water Courses, Profius and appurtenances Whatsoever to the said Moyety or third parte of said Tenemts & premises belonging, and all the Estate right of said Property of them the sd ERASMUS WETHERS and FRANCES his Wife to the same Witnesseth now this Indenture that for the further & more assurances of the sd Moyety or one third parte of the said Tenemts togeather with ye Rents and yearely profius ariseing from the same unto the said FRANCIS LEE and his Heires they the said ERASMUS WETHERS and FRANCES his Wife doe by these presents grant wth the said FRANCIS LEE his Heires as followeth (Vizt) That they the said ERASMUS WETHERS & FRANCES his Wife will at & before the first day of June wch shall in the yeare of or Lord 1679 at the request of the said FRANCIS LEE and his Heires according to the usuall Course of ffynes and recoveryes accustomed one Lawful! and Sufficient recovery to be had & made agt him the said ERASMUS WETHERS and FRANCES his Wife and theire Heires unto ye said FRANCIS LEE of all that Tenemts to the intent that a Lawfull and Sufficient Recovery may be had of all ye Premises. Attorney for me to recover and receive by all Lawful! meanes whatsoever of and from Mr. ERASMUS WETHERS heretofore of Midx. County in Virga, all such Debts, Grants and Bargaines in any case oweing & belonging to me by Bill Bond Specialty Accompt or otherwise granting unto my said Attorney full power concerneing the premises as well the said ERASMUS WETHERS as alsoe all other persons whome it may concerne Allowing & Confirmeing all whatsoever my said Attorney his Substitute. or Substitutes shall Lawfully doe And in case of the death of my Worthy ffriend RALPH WORMELEY Esqr.       EQUITABLE PROPOSALLS offerred to Mr' ERASMUS WETHERS of Virga by the Complaymt if the said WETHERS expects that the said Plaintiffe should not Sue the sd WETHERS Bond for 1600 lb. wch is Legally forfeited
      First because the Plaintiffe gave the said WETHERS possession of a Valuable Estate in NORTHUMBERLAND COUNTY in Virga ye 18th of April! 1677 upon the Protestations and Assurances made by said WETHERS that he would give the Plaintiffe besides his Bond sufficient Securaty by two Substantial! Men the Plaintiffe should approve of for performean ce of a Deed granted by the said WETHERS to ye Plaintiffe beareing date the 10th of Aprill 1677 Now the said WETHERS knowing the Short time the sd Plaintiffe was confined to for his stay in Virga. never came neare ye Plaintiffe to performe his protestations for ye sd Plaintiffs Disadvantage in equity togeather wth the greate Adventure he was Compelled thereby to Undergoe by giveing the sd WETHERS Possession of Soe valuable an estate and ye sd WETHERS makein g suitable Returnes Thirty pounds is esteemed a moderate compensation
      2dly As by Receipt acknowledged by sd WETHERS in the Conveyance it appeareth he hash Recd. Caution from the said Plaintiffe for 900 lb Sterl. in Consideration of an assurance the said WETHERS then passed to the said Plaintiffe satisfying his proportion of Annual! Rent conveyed to the Plaintiffe the amount of 47 lb. and upon examinacon as will appeare at large the Yearely rent falling Short 01 lb - 02 s- 04 d a proportionable abatemt. is expected by ye Plaintiffe, 18 lb. 18s - 08d,
      idly That Whereas ye aforesd. WETHERS by Venue of the conveyance passed to the Plaintiffe warranted ye whole and every parte of the sd Tenements: to be lett out in Lease to Sufficient persons, wch did inhance the value of the aforesd Tenemts. and greately encouraged the Plaintiffe to purchase the Same and since ye Plaintiffe can make appeare by evidences that ye Annual] rent of ye 5 lb 19; parte of ye aforesd tenemts. from being in Lease that there is Seldame any rent paid for the same being a parte of Small Tenemts: much decayed & Such as noe persons will take Leases of at halfe ye value Warranted or if to be purchased will sell in proporcon to those that are in Lease for above halfe ye price ye Plaintiffe therefore requires an adequate remiedy for that Damage (Vitt. 27 lb p Ann at 800 lb 15 lb 19 is to the half of which deducted)

      Lastly That Whereas the said WETHERS hath absolutely reced 600 lb in hand of the said Plaintiffe and hath not legally and according to Agreemt. possessed the Plaintiffe of the aforesd Tenemts by wch meanes yee Plt is made uncapable of prosecuting his Designe in makeing Sale thereof as alsoe is compelled for ye Space of five (blurred) years at least to be lyable to ye hazard of (fire wch God in his mercy avert and hath noe Valuable considerations for ye danger wch if it should happen dureing this Space, might tend to ye almost ruine of the said Plaintiffe yet he is contented to accept of ffifty pounds as Satisfaction for the premises As alsoe that ye aforesaid Plt may be remibursed his Charges for Councell attending ye Law Courts landlord & Tenants expences on ye same his many iourneyes and impedimts: to his affaires considered parte of all wch Mr. PORTEUS and Capt. NUSUM can Evidence the same valued but at 6 lb;
