      Memorandum that on the special petition of Henry Waters of PGCo preferred to the justices of the county on the Monday before the 4th Tuesday in September 1786 for a land commission that was issued on October 4, 1786; to Messrs Baruch Duckett, Mordecai Jacob, William Hall s/o Benjamin and Thomas Boyd of PGCo Gentleman, whereas Henry Waters is seized of a tract called "Cherry Walk" and preferred his petition in writing to our county court held at Upper Marlborough Town for a commission to examine evidence to prove and perpetuate the memory of the bounds of the said tract of land. Therefore, we command you any three or two of you to examine all witnesses or persons concerned touching their knowledge of the bounds of the said tract.       In pursuance of a commission to examine evidences to prove the bounds of "Cherry Walk" we met on Thursday, November 2, 1786.
      William Waters of Montgomery County, Maryland aged 70 years or thereabouts being at a stone in Henry Water's field standing 350 yards form the dwelling house of the late Samuel Waters saith that at the time "Cherry Walk" was taken up he carried one end of the chain and James Beck was the surveyor and they began at a white oak standing on the river bank being the lowest bounded tree of the resurvey of "Jerico" and they run southwest for a line of "Jerico" at the end they bounded the nearest tree for the beginning tree of "Cherry Walk" and the aforesaid stone is near the place the bounded tree stood.
      Robert Waters aged 43 years or thereabouts affirms at the same place that about 20 years or upwards his father Samuel Waters gave notice by advertisements that the bounded tree of "Cherry Walk" was down had he intended to set up a post and the aforesaid stone is near the place the post was planted.
      Belt Mullikin of Anne Arundel County, Maryland aged 38 years or thereabouts at the same place saith about 12 years ago Arnold Waters called on him amongst others to plant bounded stones at a post standing in Henry Water's field where he planted a stone for the boundary of "Jerico" and "Cherry Walk"
      William Waters of Montgomery County, Maryland at a box white oak on the east side of Arnold Water's old field and on the edge of Deep Bottom saith he assisted in carrying the chain when "Cherry Walk" was taken up that the division between this deponents father and brother John Water was from this tree. The commissions adjourned to December 1, 1786
      Thomas Mullikin of Anne Arundel County, Maryland at a stone in Henry Water's field about 350 yards from the dwelling house of the late Samuel Waters saith about 12-13 year ago he was called on by Arnold Waters to plant a stone at a post planted for the 3rd boundary of "Jerico" and the beginning of "Cherry Walk" and the said Arnold told him that there had been a dispute between Samuel Waters, Mordecai Waters and his father where the post should be planted where the said Arnold fixed the stone.
