      KNOW ALL MEN by these presents that I THOMAS BUTLER doe oblige myself to shipp aborde the ELIZABETH of LONDON GEORGE BROWNE Master three hogsheads of Tobacco the choycest of my Cropp being sweet rented and the said Three hogsheads Mr. DANIELL HUTT is to receave marke & when itt arives att LONDON to dispose thereof for the use & behoofe of me the said THOMAS BUTLER and out of the proceeds of the said 3 hogsheads of Tobo: to pay himselfe twenty two pounds Sterling & the overplus the said DANIELL all the next shipping to send me the said THOMAS BUTLER in finning & woofing cloth shoos stockins & such like goods as are usually venable in Virginia but in the case the said 3 hhds of Tobo: when disposed of doe not fully pay the twenty two pounds Sterling wch I owe I am indebted to Mr. DANIEL HUTT and the proceeds of these 3 hhds. of Tobaccoe falleth short of 22 lbs, then I the said THO: BUTLER doe obleige myselfe my heirs upon notice from Mr. DANIELL HUTT to pay or cause to be payd unto the said DANIELL or his Order in good sould merchantable tobacco whatsoever it shall be short of the sd 22 lbs & this Tob: is to be payd to Mr. HUTT or his order in RAPPAHANNOCK County or River alwaies Provided that he the said DANIELL HUTT shall stand to the adventure & all cassulties of the said 3 hhds. of Tob: & if in case the sd 3 hhds be lost either by Sea or other accident then the said DANIELL is fully satisfied & Payd the 22 lbs aforesaid & this Condition to be void & of none effect Else to stand in full power force & Virtue. Hutt, late of Nominy in this county, and did therein sett forth that Dann: Hutt by the name of Dania: Hutt of London,-merchant, did by a deed under his hand and seale 20 Sept. 1670 for the consideration therein expressed sell unto Fra: Chaplin by the name of Francis Chaplin, citizen and merchant of London, 1505 acres in NominY River together with all the plantations and houses and orchards thereon erected and established and also twenty seaven servants and 100 head of cattle with provise that if Dann: Hutt should at a certain day make payment of 640 sterling unto Fra: Chaplin, then the deede to be utterly voyde. Neither -Dann: Hutt' or any of his heires have made payment. The. Court.. doth order that the Sherriffe eject Mr. Jno: Crabb the present possession the land and put Coll. Nich: Spencer in possession of the land in the behalfe of Sir Fra: Chaplin.
