      - Rappahannock County Court 4th of September 1685
      - Whereas PHILLIP SHERWOOD late of this County dyed seized in fee of a certain tract of land lying and being on the North side of Rappa: River in the freshes thereof which sd land doth now lawfully come vest in MARY, MARTHA, SARAH and ANN, the foure Daughters & coheirs of the sd PHILLIP SHERWOOD; And Whereas THOMAS MARSHALL who marryed SARAH, one of the coheirs, did in right of his Wife bring his action in this Court against FRANCIS JAMES, who marryed MARY, the Eldest of the sd Daughters, and shows that the sd JAMES did contrary to Law and without the mutual consent of the sd Sisters & coheirs make devision of the land aforesd., But it being made appeare that MARY & MARTHA, the two Eldest Daughters of the sd PHILLIP SHERWOOD were of full age & did consent to the division aforesd. the Court seriously weighing the matter have ordered the division of the sd land already made do continue good & firme until! such time as the Youngest Daughter of the sd SHERWOOD shall move for a new division thereof

      In the name of God Amen I Francis James of Sittenburn Parish in the County of Richmond being sick and weak of body but of perfect mind and memory do make and Ordain this my last Will and Testament in manner and form following.
      Imprimis: I give and bequeath my Soul to the hands of God that gave it hoping thro the merits and mediation of my Dear Redeemer Jesus Christ to receive the same at the General Resurrection with free pardon and Remission of all my Sins My body to the Earth to be decently buried as my Executrix hereafter named shall think fit. And astouching my worldly Estate wherewith it has pleased God to bless me with, I do dispose of after the following manner, Viz.
      Item: I give and bequeath unto my Loving son Sherwood James all that Plantation whereon I now Live being fifty acres to him his heirs and assigns forevermore.
      Item: I give and bequeath to my Loving son Sherwood James that fifty acres of land that I bought of my Sister in law Martha Marshall adjoining upon the above fifty acres and also upon the branches of Thatcher's Dam to him and his heirs and assigns forever-more.
      Item: I give and bequeath unto my Loving son Sherwood James one young bay Mare branded with I F on the near buttock when he shall arrive and come to the age of 21 years.
      Item: It is my Will and Desire that all the rest and residue of my personal estate should be equally divided between my Loving Daughter Jane James and my Loving wife Margaret James. I do also hereby nominate and appoint my Loving wife Margaret James whole and sole executrix of this my last Will and Testament hereby utterly Revokeing all former Wills by me heretofore at any time made do own and acknowledge this my last Will and Testament as witness my hand and Seale this 24th day of October 1717.

      At a Court held for King George County the Seventh day of July in the year of our Lord 1721: The last Will and Testament of Francis James dec. was presented into Court by Margaret James widdow his Executrix who made oath thereto and being proved by the oaths of Peter Jett and Mary Hasell witnesses thereto is admited to Record. And on the Motion of the said Margaret James and her performing what is usual in such cases, Certificate is granted her for obtaining a Probat thereof in due form.
