      Charity Henley Coates (Courts) married (2) Colonel John Contee and died herself before 1708 when Colonel Contee, gentleman of Charles County, made his will which was proved on 21 August 1708. The legatees of Colonel Contee included Charity, Charles, William and John Coates, his children-in-law (stepchildren) by marriage with Mrs. Charity Coates, widow of John Coates. Stepson John Coates was bequeathed two parcels of land that had been left to him by his father. The other children were to receive personal property when they became of age. Charity's son Henley and daughter Anne were not mentioned. After the death of Charity, Colonel Contee then apparently married someone named Mary (unknown maybe Townsley)). He left his own extensive land holdings in Charles County to his wife Mary; mother Grace Contee and sister Agnes Berry of England; his brother Peter Contee of Barnstable, England; and his nephew Alexander, son of brother Peter. He left personalty to nephew John, another son of brother Peter. The unsigned will was proved by depositions of Philip Lynes, Francis Pearson, John Frasier (Clerk Rector of Portobacco Parish), Colonel James Smallwood, Elizabeth Berry, spinster, aged 30, Alex Contee, gentleman, aged 17 years, John Courts, gentleman, aged 17 years, and John Warren, aged 21 years (Liber 12, folio 276). This indicates that Colonel John Courts and Charity Henly Courts (Coates) must have died rather young with their children in their minority. Colonel Contee apparently had no children by either Charity Henley Coates or his second wife Mary. Madam Mary Contee was relict and executrix of the will of Colonel John Contee, whose home house was at Portobacco (Charles County: Probate Records, Inventories, Book 1677 1717, page 278). Mary Contee married (2) Philemon Helmsley who died in 1719 (Liber 15, folio 260, MARYLAND CALENDAR OF WILLS, Volume IV).
