      I, Henry Brawner of CC, being sick and weak of body, but of sound and disposing mind, memory and understanding;
      To wife Maria Campbell Brawner, my dwelling plantation called "Ellerslie" as it now stands being all the land I own in one body on the west side of Port Tobacco Creek, most of which was purchased of the trustee of the late Daniel of St. Thomas Jenifer, together with all the personal property (except negroes). I make this bequest as an act of justice to my wife as renumberation for her land sold by me agreeably to an understanding between us, but it is also to be in lieu of all dower to which she is or may be entitled.
      Item: all the rest and residue of my property to my wife during her life in trust for the benefit maintenance and education of my children and after her death equally divided among my children.

      At the request of Samuel Hanson Briscoe the following Deed was recorded June 21, 1804
      This deed made June 7, 1804; Ann Yates in consideration that Samuel Hanson Briscoe of Allegany County, Maryland hath agreed and engaged to resurvey the lands tenements and hereditaments by this deed for and during her natural life without impeachment of or for waste remainder thereof after her death to Rebecca Morgan Young wife to Henry Hawkins Young, James Bruce Barber wife to Luke Philip Barber and Elizabeth Yates, cousins by consanguinity to the said Ann Yates, and Jonathan Yates, Judith Townly Yates and Maria Yates legitimate children of Townly Yates deceased who was cousin by consanguinity to the said Ann Yates and assigns forever in fee simple as tenants in common in manner and proportion following, to wit;
      To Rebecca Morgan Young, Jane Bruce Barber and Elizabeth Yates, each 1 undivided 1/4 part constituting 3/4th thereof
      To Jonathan Yates, Judith Townly Yates and Maria Yates each 1/4th of the same constituting the remaining ΒΌ part;
      And also with intent that every estate to be granted so that Samuel Hanson Briscoe being hereby vested with an absolute estate in fee simple may be enabled by deed to settle the real estate of the said Ann Yates to settle the her real estate and be the instrument to carry her affectionate and loving intentions towards her near relation by consanguinity aforesaid and also in consideration of the sum of 5 shillings paid by Samuel Hanson Briscoe assigns in fee simple all those two tracts of land lying on Wicomico River, "New Horse Shoe" containing 572 acres and "Yates Hope" containing 200 acres.       Samuel Hanson Briscoe formerly of Allegany Co., but now of St. Mary's Co., MD of the first part, Ann Yates of Charles Co. of the second part (she may be the wife of Dr. Townley Yates) Rebecca Morgan Young wife of Henry Hawkins Young of Montgomery Co., Janet Bruce Barber, wife of Luke Philip Barber of Charles Co., Elizabeth Yates of Prince Georges Co., and Jonathan Yates and Maria Yates who is called Maria Campbell Yates and Judith Townley Yates, dec'd all children of Doctor Townly Yates deceased of Charles Co., in the State aforesaid.
