      (4) Lancaster County, VA indenture between Sir Henry Chichley of Rosegill, Middlesex County, VA, Knight, and Ralph Wormeley, of the same place, Esquire, son and heir of Ralph Wormeley, Esq., deceased, and Agatha his wife. The said Ralph Wormeley, deceased, was possessed of a considerable estate in houses, land, plate, jewels, goods, household stuff, horses, mares, tobacco, negroes, English servants and other estate in the counties of York and Lancaster (now Middlesex), and said Ralph Wormeley deceased left his estate to his wife, who afterwards married Sir Henry Chichley; but before the marriage she settled the estate upon her son, Ralph Wormeley, the younger, who at the time of the marriage was under age of 21; said Chichley, in payment of the profits of the estate which he has received, conveyed to said Ralph Wormeley, the younger, 700 acres in Middlesex and certain goods (per schedule)...

RALPH WORMELEY deced, send Greeting in our Lord God everlastinge. Whereas ye sd Dame AGATHA duringe her Widdowhood did by two severall Deeds each bearinge date ye one & thirtieth daye of Maye in ye yeare 1652 for- severall causes there inexpressed do give grant make over & in feoffe unto her two Sonns.       THIS INDENTURE made the second day of March 1677 And in the Thirtieth yeare of the Raigne of or. Soveraigne Lord CHARLES the Second Betweene the Rt Honable Sr. HENRY CHICHELEY of ROSEGILL in the County of Middlesex in Virga Knt of one parte and RALPH WORMELEY Esgr. of the same place and County Esgr, Son & Heire of RALPH WORMELEY Esgr late deceased and AGATHA his Wife of other parte. Whereas yee said RALPH WORMELEY deced in his lifetime and at the time of his death was lawfully possessed of a Considerable estate in Houses, Land, Plate, Jewills. Goods, Household stuff, Horses, Mares, Tobaccoes, Negroes, English Servants and other Estate within the Countyes of YORKE and LANCASTER (now the said County of Middx in Virga:) which sd estate at the time of his decease he gave & bequeathed unto ye said AGATHA his Wife wch. said AGATHA WORMELEY after ye Death of the said RALPH WORMELEY intermarried wth the said Sr HENRY CHICHELEY: but before the said marriage was Compleated, the sd AGATHA WORMELEY by an Instrument in Wrighting under her hand & Seale settled the said Estate upon yee said RALPH WORMELEY party to these presents as by the said Wrighting under ye hand and Seale of the said AGATHA WORMELEY more perticulerly and at large may appeare; Soe that the said Estate is lawfully decended and come unto the said RALPH WORMELEY the Younger; And Whereas the said RALPH WORMELEY the Younger at the time of the said Intermarriage of the said Sr: HENRY CHICHELEY wth the said AGATHA WORMELEY the Wife of the said RALPH WORMELEY deced was an Orphant under the age of One & Twenty yeares, and the said Sr. HENRY CHICHELEY by Vertue of the said Intermarriage became Guardian over the said RALPH WORMELEY the Younger and the said Estate dureing ye Noneage onely of the said RALPH WORMELEY yee Younger; Nevertheless the said Sr: HENRY CHICHELEY hath (not onely since the said Intermarriage But alsoe since the said RALPH WORMELEY the Younger attained to said age of One and Twenty yeares) enjoyed the said Estate and received the Rents Issues and Profitts thereof without rendering giveing any Accompt of what hath been expended out of the estate either for the maintenance & Education of the said RALPH WORMELEY ye Younger or of the rents issues & profitts thereof, and without makeing any restitution for what waste and Spoyle hath been done to the said estate or the product thereof by the said Sr: HENRY CHICHELEY or by his procurant: since his Intermarriage wth the said AGATHA WORMELEY Witnesseth now this Indenture that the sd Sr. HENRY CHICHELEY (as well for the reimbursemt: and repaymt: of such parte and Soe much of the rents issues and profitts of the said Estates as are yet behinde and unpaid, as alsoe for the makeing restitution for all such waste and Spoyle as hath from time to time been done to ye sd estate or the Stock or product thereof by the said Sr. HENRY CHICHELEY or by his Procuremt: since his Intermarriage wth said AGATHA WORMELEY as aforesd) Hath granted & confirmed unto the said RALPH WORMELEY his Heires and assignes for ever, All those Seaven hundred acres of land being in the County of Middlesex, upon the South side of RAPPA.       THIS INDENTURE made the five and twentieth day of December Ano Dom 1674 Betweene the Honble Sr. HENRY CHICHESLEY of the County of MIDDLESEX in RAPPA RIVER in Virginia Ent. of the one pte and Capt. RALPH WORMLEY of the same County Gent of the other pte Witnesseth that the said Sr. HENRY CHICHESLEY as well for and in consideration of a Demise or Lease of a plantation whereon the said Sr. HENRY CHICHESLEY now liveth made and granted unto him by the said Capt. RALPH WORMLEY wch the said Sr. HENRY CHICHESLEY doth hereby acknowledge as also for divers other good causes & considerations him thereunto moving path sold and confirmed and doth by these presents for himselfe his heirs and assigns sell unto the said Capt. RALPH WORMLEY or his assigns) together with all Escripts writings and Minuments Patents and Surveys whatsoever touching and concerning the premises onely or onely any pte or parcel thereof to have and to hold the said Plantacon and premises with their appurtenances unto the said Capt. RALPH WORMELEY his heirs and assigns forever in as large and ample manner as are expressed in the said Pattent menconed the Rents and Services and Provisoes in the said Pattent menconed conteyned and expressed and the said Sr HENRY CHICHESLEY doth for himself his heirs promise with the said Capt.       TO ALL XPIAN PEOPLE to whome this prsent writing shall come, I CUTHBERT POTTER of the Parrish of Christ Church in the County of MIDDLESEX in Virginia send Greeting. Whereas THOMAS CHETWOOD (by the name of THOMAS CHETWOOD of the County of LANCASTER Gent.) did by his Deed Poll or bargain e & sale bearing date ye fowerteenth day of Novembr: 1668 (for the consideration therein mentioned) grant unto me the said CUTHBERT POTTER my heirs the full moyety of one halfe i part of a tract of land contaying Five thousand Two hundred Seaventy five acres in the whole taken up and Pattented by the said THOMAS CHETWOOD and JOHN PROSSER in their names equally in Copartnership but under both their hands & seales dated ye Sixth and Twentieth day of July 1667 the said land being scituate and being in the Freshes of the Rappahannock River on the North side thereof and known by the name of NANZEMUND INDIAN TOWNE in the County of Rappa: aforesaid, wax said land (amongst others) by Pattent from Sr. WILL: BERKELEY dated at JAMES CITTY ye Twenty eighth day of September 1667 and under the Seale of the Collony was granted unto the said THOMAS CHETWOOD and JOHN PROSSER as by the said Pattent & certain articles of Agreement between the said THOMAS CHETWOOD and JOHN PROSSER may more at large appeare. Now Know ye that I the said CUTHBERT POTTER for divers valluable causes me theretunto moveing have sold unto RALPH WORMLEY Esqr , his heirs and assigns forever, Two thousand acres of land part of the said moyety or one half part the said Five thousand two hundred seaventy five acres and soe held at ye dividing lyne adjoyning to the lands of Mr. ANTHONY SAVAGE, WILLIAM STROTHER & SYMON MILLER, and soe runing up Rappa: River including NANZEMUND TOWNE & the Plantation thereunto belonging as by the said Pattent and Survey thereof may more fully appeare. To have and to hold the said Two thousand acres of land with the due share of mines and mineralls with all rights and privilidges and all proffitts & hereditaments whatsoever belonging and all the Estate right to the same unto the said RALPH WORMLEY his heirs in as full manner as the same was pattented by the said CHETWOOD & JOHN PROSSER and by the said THOMAS CHETWOOD settled upon to me the said CUTHBERT POTTER as aforesaid upon speciall Trust nevertheless to the uses & purposes hereafter expressed and declared (yt. is to say) to the use of KATHERINE WORMLEY, second Daughter of the said RALPH WORMLEY and KATHERINE his Wife, for and during the term of her natural! life and in case of the death or departure out of this life of the said KATHERINE the Younger to the use and behoofe of ELIZABETH WORMELEY, one other of the Daughters of RALPH WORMLEY and KATHERINE his Wife for and during the term of her naturall life and in case of the death of the said KATHERINE and ELIZABETH shall be by the said RALPH WORMLEY begotten on the body of the said KATH: his Wife Successively as they shall be in Seniority of age and priority of Birth and in default of such issue to the use of the sd RALPH WORMLEY his heires forever and I the sd CUTHBERT POTTER doe grant to said RALPH WORMLEY his heires as followeth that I the said CUTHBERT POTTER doe for me my heires the said lands unto RALPH WORMLEY his heires against all persons claiming to ye same warrant and defend forever and that I the said CUTHBERT and my heirs shall within the space of seaven years at request costs and charges in the Law of the said RALPH WORMLEY make further assurances unto the said RALPH WORMLEY as shall be reasonably required.       THIS INDENTURE made the first of July 1687 Between FRANCIS WEEKES of the Parish of Christ Church in the County of Middx. gent of one part and RALPH WORMELEY Esqr. and CHRISTOPHER ROBINSON of the Parish and County aforesaid of the other part Witnesseth that Whereas RAWLEIGH TRAVERS of the Parish of White Chappell in the County of LANCASTER hath by Deeds the 31st day of May 1687 granted unto Francis Weeks land and plantacon called by name of FFAIREWEATHER NECK being in the Parish of White Chappel in the County of Lancaster with all the Stock of cattell thereunto belonging being Fourteen cowes Eight calves and a Bull and further Witnesseth that for the naturall love and affection which the said Francis Weekes heareth towards his Wife ELIZABETH WEEKES and the issues of her Body THOMAS and HOBBS WEEKES, and for Establishing of the Inheritance of the Plantacon wth all appurtenances belonging to and in the hands of the said Ralph Wormeley Esqr, and Christopher Robinson Gentll or the Survivours of them hath granted unto the said Ralph Wormeley Esqr. and Christopher Robinson Gent all the aforesaid plantacon wth all the appurtenances (that is to say) to the use and behoofe of said Elizabeth Weekes dureing the time of her naturall life then to the use and behoofe of Thomas and Hobbs Weekes between them when they shall attaine to the lawfull age of one and twenty years Provided that if Elizabeth Weekes departe this life before Thomas and Hobbs Weeks shall
