THIS INDENTURE made the twenty fifth day of October in the Seventh year of the Reign of our Sovereign Lord George the Second by the grace of God of Great Brittain France and Ireland, King, Defender of the faith &c., And in the year of our Lord one thousand seven hundred and thirty three; Between HOWSON HOOE of the Parish of St. Paul in County of STAFFORD, Planter, of one part and JOHN POPHAM of Parish of Washington in County of Westmorland, Planter, of other part; Witnesseth that HOWSON HOOE in consideration of sum of five shillings to him in hand paid by JOHN POPHAM, the receipt whereof HOWSON HOOE doth hereby acknowledge, path and by these presents doth bargain and sell unto JOHN POPHAM all that parcell of land scituate in Parish of Washington and County of Westmorland containing by estimation in the whole One hundred and five acres; Begining at a marked Gum standing close by the Dam near JORDANS BRIDGE and the Main Road, thence extending ramie' with the Main Road South 32 degrees East 120 poles to a marked Hickory, corner tree of the said land, thence extending along a line of marked trees North 61 degrees East 180 poles another corner tree standing near the Main Dam of Upper MACHOTICK CREEK, thence up the severall courses of the Dam to the begining; which includes One hundred and five acres of Land; Together with all houses, tobacco houses, barns orchards advantages and appurtenances to the land and premises belonging; To have and to hold the land and premises with appurtenances unto JOHN POPHAM during the term of one whole year, paying therefore the Rent of one Ear of Indian Corn on the Birth Day of our Lord God next ensueing if lawfully demanded to the intent that by virtue of these presents and by force of the Statute for transferring uses into possession, JOHN POPHAM may be in i the actual possession of the premises and be thereby enabled to take a Release of the inheritance thereof to him and his heirs; In-Witness whereof HOWSON HOOE hath hereunto sett his hand and seall the day month and year first above written

TO ALL PEOPLE to whom these presents shall come HOWSON HOOE and ANNE FRANCES his Wife send Greeting. Whereas NATHANIEL HARRIS by his Last Will and Testment bearing date the fourth day of October one thousand seven hundred and Eighteen among other things did give to his Son WILLIAM HARRIS and the heirs of his body lawfully begotten Two hundred and fifty acres of land being part of a PATENT of Six hundred and Forty acres being on the North side of OCCOQUAN commonly called and known by the name of BUCKHALL and for default of such heirs then to his Daughter ANNE HARRIS now ANNE HOOE to her and her heirs forever and the said NATHANIEL HARRIS further by his said Will did bequeath to his Daughter the said ANNE the heirs of her body lawfully begotten Two hundred and Fifty acres of land part of the PATENT called BUCKHALL and for default of such heirs then to his Son WILLIAM HARRIS to him and his heirs forever and then the said NATHANIEL HARRIS gave the residue of the said PATENT of land being One hundred and Forty acres to PEYTON BUCKNER and ELLIS MARQUIS to be equally divided between them And Whereas the said WILLIAM HARRIS dyed without issue of his body lawfully begotten whereby the said Two hundred and fifty acres of land devised to him as aforesaid descended to her the said ANN in fee simple pursuant to the devise aforesaid and the residue of the said PATENT given by Will of said NATHANIEL HARRIS to PEYTON BUCKNER and ELLIS MARQUIS was purchased from said PEYTON BUCKNER and ELLIS MARQUIS for a valuable consideration by the said HOWSON HOOE party to these presents by Deeds remaining of record and WHEREAS also the said HOWSON HOOE and ANNE FRANCES his Wife, Daughter of the said NATHANIEL HARRIS the Devisor, have since their intermarriage had several children among whom are HOWSON their Eldest Son who has the right in the remainder to the said Two hundred and fifty acres of land given to his Mother the said ANNE as aforesaid and JOHN their second Son and the said HOWSON HOOE and ANNE his Wife being willing and minded to give the said Tract of Six hundred and forty acres to their Sons the said HOWSON and JOHN in severalty so as that Two hundred and fifty acres of the same may be taken for that quantity which he the said HOWSON the Son and his heires may hereafter claim as heir at Law to his said Mother ANNE of in and to the same Now Know yee that we the said HOWSON HOOE and ANNE FRANCES his Wife for the natural love and affection which we bear unto our Sons the said HOWSON HOOE and JOHN HOOE and also for their better maintenance do give them all that parcell of land above mentioned being on the North side of the OCCOQUAN RIVER commonly called and known by the name of BUCKALL containing as per PATENT Six hundred and forty acres of land to be held by them forever in severalty in manner following that is to say to said HOWSON HOOE and his heirs half part of the said parcell of land where he the said HOWSON HOOE the Son now lives and including the said Two hundred and fifty acres which he may hereafter lay claim unto in virtue of being heir at law to his Mother ANNE and the other half part of the said parcel! of land to said JOHN HOOE his heires and assignes for ever.
