Indenture made June 3, 1769; between James Downing, planter of PGCo and Nathaniel Downing, planter of Charles County, Maryland, s/o James Downing late of PGCo, deceased of one part and Samuel Middleton Marlow of PGCo of the other part. Witnessed that whereas James Downing father of the said James Downing and Nathaniel Downing died seized in fee to tracts called "Dublin" containing 130 acres, "Foxes Denn" containing 100 acres, and parts of "Westmoreland" and "Good Will" containing 53 acres (the last two bounded by the School House Branch). And whereas James Downing, deceased by his last will and testament did give and bequeath to his son James Downing 71 acres, part of a tract called "Dublin" lying on the Sapling Branch and likewise all the rest of his lands after the decease of his wife Ann Downing provided his son James Downing paid unto his three other sons, Henry Downing, John Downing and Nathaniel Downing the quantity of 2000 pounds of tobacco each when they came to the age of 21 years. And the said James Downing not complying with the proviso expressed in his father's will in making the payment to Henry Downing, John Downing and Nathaniel Downing became seized of their equal share agreeable to the last will and testament of James Downing their father by estimation about 71 acres each. Now this indenture further witness that James Downing and Nathaniel Downing in consideration of 68 pounds 13 shillings current money paid by Samuel Middleton Marlow has sold part of the aforesaid tract called "Dublin" containing 71 acres and bounded by the Sapling Branch, and also all the estate right title interest claim and demand whatsoever to the aforesaid tracts called "Dublin", "Foxes Denn", "Westmoreland" and "Goodwill" which their father died possessed of. Indenture made September 16, 1769; Henry Downing and John Downing, sons of James Downing late of PGCo deceased of one part and Samuel Middleton Marlow of the other part. Whereas James Downing, father to the aforesaid Henry Downing in John Downing died seized in fee to the following tracts of land; "Dublin" containing 130 acres, "Foxes Denn" containing 100 acres, and parts of "Westmoreland" and "Good Will" containing 53 acres, and whereas James Downing by his last will and testament did give and bequeath to his son James Downing 71 acres of land, part of Dublin after the decease of his wife Ann Downing provided his son should pay unto his 3 other sons Henry Downing, John Downing and Nathaniel Downing the quantity of 2000 pounds of tobacco each when they should come to age of 21 years and the said James Downing not complying with the proviso expressed in his father's will his brothers became seized in equal share of the lands by estimation about 71 acres each. Now this indenture further witness that Henry Downing and John Downing in consideration of 142 pounds current money to them paid by Samuel Middleton Marlow have sold all the estate right title interest and claim of them to the aforesaid parcels of land whereof James Downing father to the said Henry Downing and John Downing died possessed of.
