      1347-1349. John Murdock and by order of Frederick County Court, the following Commission and depositions are recorded. To Charles Jones, Robert Peter, Anthony Holmead and Erasmus Gill
      Whereas John Murdock ofthe county aforesaid is possessed ofthree tracts: one Philip and Jacob, one Whitehaven, and likewise a part of a tract called Friendship, petitioned before Thomas Beatty and his associates to examine evidence to prove and perpetuate the memory of the bounds ofthe aforesaid tract. Issued 25 day of June 1764, by John Darnall.
      Deposition of Col. George Beall aged about 70 years, relating to beginning tree, now a heap of stones, of land called Philip and Jacob also the beginning of a tract of land called Whitehaven, sayeth that. Capt. James Edmonston took up a tract called Amsterdam, that he this deponent was present and heard the said Edmonston say that here was the beginning, meaning the heap ofstones, of White Haven and Philip and Jacob, and that he the said Edmonston, made his beginning for Amsterdam at the said heap of stones. Further says that he believes and understood that Friendship has a reference to Philip and Jacob and Whitehaven, and that he has no land situated with any of the tracts. 5 August 1765.
      Deposition of Captain George Beall, aged about 30 years, says the beginning tree, now a heap of stones, of a tract called Philip and Jacob and also of a tract called White Haven, sayeth that his father about 15 years ago told him that the heap of stones was the beginning of the two tracts. 5 August 1765.
      Deposition of Samuel Magruder, aged about 57 years, says that about 37 or 38 years ago, the aforesaid land then in the possession of one Powell, and that the said beginning was proved by Charles Beall and John Flint Senr., this deponent being on that occasion one of the juryman, and says further that a white oak stump with two large stones set against it standing near the bank ofthe River Potowmack, and near to the mouth of Rock Creek is the stump ofthe tree which was the beginning tree ofthe aforesaid tract ofland then in the possession of one Powell, and it was then taken up by one John Evans, but this deponent does not remember to have heard the name ofthe land. 5 August 1765.
      Deposition of Samuel Magruder the third, aged about 57 years relating to the beginning of a tract of land, says that he was informed 37 or 38 years ago that the beginning tree was standing near the end of the first line of Evan's Land.
      Deposition of Col. George Beall aged 70 years. That about 30 years ago, he was in company with John Flint, who showed him a hickory for the beginning tree of Friendship, and that a locust post now fixed in the ground is in the very spot where the hickory stood, near the main road from George Town to Frederick Town, in the very place where Charles Beall showed him this deponent about 45 years ago, and that said was a tree of Addison's land called Friendship.

      father showed him was the beginning place ofFriendship; and he was showed the same place by Mr. William Dent afterwards. 5 August 1765.
      Deposition of Ninian Tannahill, Senior, aged about 73 years, relating to a tract called Friendship, which he understood was taken up by Mr. Stoddart and Mr. Thomas Addison, says that a split rock standing to the south westward about 100 yards from Thomas Grave's plantation was showed to him about 37 years ago by John Allison to be the end of said land. 5 August 1765.
      Deposition of John Dowden Senr., about 64 years, being first sworn, relating to a boundary of a tract ofland called "Friendship," which was taken up by Mr. Stoddart and Thomas Addison, that a split rock standing about 300 years from Thomas Grave's plantation was shown to him by both George Beall and John Allison Senior to be the corner ofthe tract of land called friendship. 5 August 1765.

      This Indenture made this twenty ninth Day of April in the Year seventeen hundred and sixty eight Between Thomas Addison Junior of Prince Georges County in the Province of Maryland Gentleman of the one part and Addison Murdock of the same County and Province Gentleman and John Murdock of Frederick County in the Province aforesaid Junior of the other part Witnesseth that the said Thomas Addision Junior for and in Consideration of the sum of five shillings Sterling Money to him in Hand paid by the said Addison Murdock and John Murdock at and before the ensealing and delivery hereof the receipt whereof he doth hereby acknowledge and therefrom acquit and discharge the said Addison Murdock and John Murdock their Heirs Executors Administrators and Assigns by these presents Hath granted bargained and sold and by these presents doth grant bargain and sell unto them the said Addison Murdockand John Murdock All the Right title Interest property Claim and demand whatsoever as well in Law as in Equity of him the said Thomas Addison Junior of in and to a Tract or parcel of Land called Addisons Choice lying and being in Frederick County and of in and to every part and parcel thereof together with all and singular the Houses Outhouses Edifices Buildings Gardens Orchards Meadows Commons Pastures feedings Trees Woods Underwoods ways paths Waters Water Courses Easements profits Commodities Advantages Emoluments and Hereditaments whatsoever to the same belonging or in any wise Appertaining And the Reversion and Reversions Remainder and Remainders Rents Issues and Profits thereof and of every part and parcel thereof with the appurtenances To have and to hold the said Tract or parcel of Land and all his the said Thomas Addison Junior's Right title Interest property claim and demand whatsoever of in and to the same and premisses and every part and parcel thereof with the Appurtenances unto them the said Addison Murdock and John Murdock their Executors Administrators and Assigns from the Day next before the Day of the Date of these presents for and during and until the full end and Term of one whole Year from thence next ensuing and fully to be Compleat and ended To the intent and purpose That by force and virtue of these presents and of the Statute for Transferring uses into possession the said Addison Murdock and John Murdock may be in Actual possession of the premisses and be thereof enabled to take and accept a Grant and Release of the Reversion and Inheritance thereof to them and their Heirs forever In Witness whereof the said Thomas Addison Junior hath hereunto set his Hand and affixed his Seal the Day and Year first above Written Signed Sealed and Delivered

      This Indenture made this twenty ninth Day of April in the Year seventeen hundred and sixty eight Between Thomas Addison Junior of Prince Georges County in the Province of Maryland Gentleman of the one part and Addison Murdock of the same County and Province Gentleman and John Murdock of Frederick County in the Province aforesaid Gentleman of the other part Whereas divers Controversies and disputes having arisen between the said Thomas Addison Junior Addison Murdock John Murdock and a certain William Murdock of Prince Georges County aforesaid Gentleman they the said Thomas Addison Junior Addison Murdock John Murdock and William Murdock for the final settlement thereof did submit the same to the determination of certain David Ross Charles Grahame and James Dick Gentleman and the said David Ross Charles Grahame and James Dick in pursuance of the said Submission did Award and Order (among other Things) that the said Addison Murdock and John Murdock should upon the payment of the sum of twelve hundred and sixty six Pounds one shilling and ten pence sterling on or before the eleventh Day of January seventeen hundred and sixty eight with legal Interest from the Date of the said Award by the said Thomas Addison Junior to the said William Murdock at the proper Costs and Charges of the said Thomas Addison Junior make and execute good and sufficient Deeds of Conveyance by Lease and Release for conveying unto the said Thomas Addison Junior and his Heirs all their Right Title Interest Property Claim and Demand whatsoever as well in Law as in Equity of in and to a Tract or parcel of Land called Addisons Choice lying in Frederick County and of in and to every part and parcel thereof with all and singular the Rights Members and Appurtenances to the same belonging or in any manner Appurtaining And further that in Case the said Thomas Addison Junior should refuse or Neglect to pay the said sum of Twelve hundred and sixty six Pounds one shilling and ten pence Sterling with legal Interest for the same from the Date of the said Award on or before the said eleventh Day of January seventeen hundred and sixty eight that upon such refusal or neglect the said Thomas Addison Junior should at the proper Costs and Charges of the said Addison Murdock and John Murdock make and execute good and sufficient Deeds of Conveyance by Lease and Release for Conveying unto the said Addison Murdock and John Murdock and their Heirs as Tenants in Common all his Right Title Interest property Claim and Demand whatsoever as well in Law as in Equity of in and to the said Tract or to have and to hold the other undivided Moiety of the said Tract or parcel of Land and the Right Title Interest and Estate of the said Thomas Addison Junior of in and to the Tract or parcel of Land aforesaid and premisses and every part and parcel thereof with the Appurtenances to him the said John Murdock his Heirs and Assigns forever to the only proper use and behoof of him the said John Murdock his Heirs and Assigns forever as Tenants in Common and not as Jointenants and to or for no other use intent or purpose whatsoever And the said Thomas Addison Junior for himself his Heirs Executors and Administrators doth hereby Covenant Grant Promise and Agree to and with the said Addison Murdock and John Murdock their Heirs and Assigns that he the said Thomas Addison Junior and his Heirs shall and will at any Time or Times hereafter at the reasonable request Cost and Charge of them the said Addison Murdock and John Murdock their Heirs or Assigns make do Execute and acknowledge or cause or procure to be made done executed and acknowledged all and every further and other lawfuland reasonable Deed or Deeds Conveyance or Conveyances Assurance or Assurances whatsoever for the further better and more perfect assuring and Conveying the said premisses hereby bargained and Conveyed unto the said Addison Murdock and John Murdock their Heirs and Assigns so that the said further Assurance contain no other Clause or warranty than is herein contained And that he the said Thomas Addison and his Heirs the said hereby bargained and Conveyed premisses to them the said Addison Murdock and John Murdock and their Heirs from and against him the said Thomas Addison Junior and all persons claiming from by or under him the said Thomas Addison Junior shall and will warrant and for       On the twenty ninth Day of April in the Year seventeen hundred and sixty eight Came the within named Thomas Addison Junior before me one of his Lordships Justices of the Provincial Court and acknowledged the within Instrument of Writing to be his Act and Deed and the Lands and premisses therein mentioned with the Appurtenances and every part and parcel thereof to be the only right and Estate of the within named Addison Murdock and John Murdock their Heirs and Assigns according to the True intent and meaning of the same writing and the Act of Assembly in such Cases made and provided At the same Time also personally appeared before me Rebecca the wife of the said Thomas Addison Junior and relinquished and acknowledged all her Right and Title of Dower of in and to the Lands and premisses within mentioned to the said Addison Murdock and John Murdock their Heirs and Assigns and she being by me examined privately apart from and out of the hearing of her said Husband declared she made such Acknowledgment and relinquishment willingly and freely and without being induced thereto by Fears or threats of or ill usage by her said Husband or fear of his Displeasure according to the Act of Assembly aforesaid

      Montgomery County Land Records, 1777-1781; Liber A1, Page 538. Lease, recorded at the request of Joseph Belt and wife. Apr 25, 1780 from John Murdock of M, to Joseph Belt and Esther, his wife, of M, for the love he has for the sd Joseph Belt and Esther, his wife, the lease to sd Joseph Belt and Esther, his wife, of 1 certain messuage, tenement, or parcel of land, now in the tenure and occupation of the sd Joseph Belt, containing about 200 acres, being that plantation whereon the sd Joseph Belt now dwells, including all that part of a tract of land called Friendship (the property of the sd John Murdock) which lies on the east side of the main road that leads from George Town to Frederick Town, and adjoining the lands of Patrick Beall, George Read, "and others", the same being in M. The term of this lease is the natural lives and the longest liver of them, paying to sd John Murdock, during the term afd, on Jan 1, 1 ear of Indian corn, when demanded. Joseph and Esther Belt promise not to waste timber, nor dispose of any timber, and if any timber fit for carpenters or coopers work or for rails shall be cut down in clearing ground or otherwise, the same shall be worked up (and not suffered to rot or perish) for the use of sd plantation or of sd John Murdock.
