      IN THE NAME OF GOD AMEN I SAMUEL SMITH of Essex County being sick and weak of body but of perfect sense and memory doe make this my last Will and Testament in manner and form as followeth
      ITEM I give unto my Son JOHN SMITH all my lands to him and his hairs for ever
      ITEM I give to my Son SAMUEL SMITH twenty five pounds Sterlg. money of England to be paid him by my Executors when he comes to the age of twenty one years but in case my said Son should die before he come to age my will and desire is that the twenty five pounds above mentioned be equally divided between my loving Wife ANN SMITH and my other three children (Vizt) JOHN and JEAN and MARY SMITH.
      ITEM my will & desire is that all my negros and all my other Estate be equally divided between my loving Wife ANN SMITH and my four children (Vizt) JOHN SMITH, JEAN SMITH, SAMUEL SMITH and MARY SMITH and to them I give my Estate and to their heirs forever
      ITEM I doe appoint my loveing Wife ANN SMITH and my Brother MAURICE SMITH and my Kindsman RICE JONES to be my whole and sole Executors and Executrix of this my last Will and Testament uterly revoking all other Wills and Testaments IN WITNESS whereof I have hereunto set my hand and Seal this Twenty Eight day of October in the year of our Lord one thousand seven hundred thirty and four

      THE CONDITION of this obligation is such that if ye above bound ANN SMITH Ex. of the Last. Will & Testament of SAMUEL SMITH deced do make or cause to be made a true & perfect inventory of all the goods chattels & credits of the sd deced the same so made do exhibit or cause to be exhibited in the County Court of Essex at such time as she shall be thereunto required by the sd Court & further do make a just and true account of her actin gs & doings therein when thereto required by the sd Court and do well & truly pay & deliver all legacies contained & specified in the sd Testament as far as the sd goods chattels & credits will thereunto extend according to the value thereof & the Law shall charge her Then this obligation to be void and of none effect . . . .

SMITH deced as follows . items listed and valued but not totalled . . (some of the items in the Inventory being) .. cattle, household furniture, kitchen utensils; ten old weeding hoes; a box of knives and forks; 13 lb of old pewter; 28 lb of useful pewter; 19 lbs of good pewter; some Cider casks; 102 lb of wool; 8 lb of wool; a parcel of uper leather; two brandy casks; a womans bridle & sadie; a parcel of flax; six beds & furniture; 76 lbs of Cotton in seeds; Two Bibles and Whole Duty of Man; parcel of old books; some remnants of goods; two hatts, money scales and powder; a parcel of mens wairing cloaths; remnant of Virginia Cloth; 4 yds Coarse Cloth; 2 ells of lining; one old horse, one mare; one negro man named Brechey, one negro man named Jack; one negro woman named Flora; one negro girl named Lucy, one negro girl named Bess; one negro girl named Letty; one negro girl named Hannah; one negro boy named Roger; one negro boy named London; Ten shillings nine pence in cash .

SMITH deced as by Order of Court dated with these presents, Now if said John Wyatt shall lawfully discharge the Trust which he hath taken upon him selfe relateing to his Gardianshipp aforesaid and shall make payment of what Estate in any wise belonging or due to said Orphans when they shall come to age to demand the same and keep the Justices from all trouble that shall or may at any time arrive concerning ye same that then this obligation to be voyd or else to stand

      KNOW ALL MEN by these presents that I CHARLES FARRELL of the County of Essex am bound unto SAMUEL SMITH of said County in full sum of Nine Thousand pounds of good & full Tobco. & Cask this 20th day of 6th day of March 1720.
      THE CONDITION of the above obligation is such that Whereas Charles Farrell hath this day agreed to sell unto Samuel Smith a parcell of land containing 80 acres it being the land which RICHARD GUGGE late of this County died seized of & since Escheated by him the said Charles Farrell Now if said Charles Farrell or his heirs when requir'd by said Saml. Smith shall freely appear in Essex County Court, & acknowledge such lawful] Deeds of Bargain & Sale as said Saml. Smith shall provide for the conveying said 80 acres & also that ELIZABETH FARRELL Wife of said Charles shall then appear & acknowledge her right of Dower then the above obligation shall be void else to remain
