      Thomas owned "Smallwood's Plains" 300 acres (1718), "Smallwood's Addition" 100 acres (1723), "Amendment" 250 acres (1728), and purchased 200 acres in Prince William County called "Moore's Rest" (formerly "Wheeler's Choice") from his sister Sarah & husband Henry Moore on 30 November, 1732. He took in the children of his deceased brother William per the Will of his father, Colonel James, for which service he was promised 2000 lbs. of tobacco. This was never paid and in 1717 Thomas sued his step-mother Mary (Executrix of his father's Will) and her new husband, Alexander Herbert, and won the suit.
      Thomas' 2nd wife Alice remarried to Thomas Middleton. Since Thomas Smallwood's son filed a caveat, his Will was not probated until 17 September 1735 by which time Alice, who was originally named Executrix, was deceased, and Thomas Middleton took over as Executor of the estate.

      Thomas was old enough to have his mark of cattle and hogs recorded, June 28, 1692.
      He was involved in various lawsuits including one seeking 2000 pounds of tobacco for taking in two of his deceased brothers children.
      Another was for libel.
      Note:
      His property included Smallwood Plains, 300 acres; Smallwoods Addition, 100 acres;
      he added and amendment of 250 acres. He purchased the 200 acre "Wheelers Choice"
      in Prince George Co. and changed the name to "Moores Rest."

      Charles County Land Record Book G#3, 1756-1761; Page 51. Instrument of Writing. CC. Mar 19, 1756. Came John Martin Sr and made oath that Thomas Metcalf told him that he wrote the will of Thomas Smallwood decd, but that the wife of the sd Smallwood persuaded Metcalf to put other words concerning some land in the will than what sd Smallwood directed, which he did, at her request, and that Metcalf came to this deponent's house & stayed for James Smallwood, son of the sd testator, to go to Colo George Dent's to make oath to what is above related. But this deponent told him he acknowledged it dangerous, and that it might probably cost him his ears, whereupon sd Metcalf refuses to go & so,
